This is the last Will and Testament of me Henry Pyke of West Wick in the Parish of Pewsey and County of Wilts Esquire as for and concerning all that capital mesuage or tenement and farm together with the several pieces and parcels of arable meadow and ley land therwith occupied and the rights members and appurtenances thereto belonging situate and being at Olney in the County of Bucks and now in the occupation of Thomas Everley or his undertenants and also all that capital messuage or tenement and farm with the cottages and gardens thereto belonging together with the several pieces and parcels of arable meadow pasture and ley lands therewith occupied and the rights members and appurtenances thereto belonging situate and being in Emberton otherwise Emmerton in the said County of Bucks and now in the occupation of Daniel Coles or his undertenants I give and devise the same and every part thereof with the rights members and appurtenances unto my brother Thomas Pyke of Wootten Rivers in the County of Wilts Gentleman and my brother in Law Richard Welford of Marlbro in the said County of Wilts Gentleman and tot he survivor of them and to the heirs and assigns of such survivor to hold the same unto and to the use of the said Thomas Pyke and Richard Welford and the survivor of them and the heirs and assigns of such survivor for ever Upon the several trusts nevertheless and to and for the several ends intents and purposes and with under and subject to the several powers provisoes and declarations hereinafter limited expressed and declared of and concerning the same that is to say upon trust that my said Trustees or the survor of them and the heirs and assigns of such survivor shall immediately upon my decease as soon after as they in their discretion shall think fit proceed to an absolute sale of the said tenement heredits and premises either by public auction or private contract in one or more lot or lots for the most money that can be gotten for the same and shall possess themselves and himself of the rents and profits in the meantime and of the monies to arise by such sale or sales upon trust to pay and discharge as far as the same will extend all and every the just debt and debts which may be due from me at my decease whether upon mortgage of all or any part of my estates bond or other specialty and ??mple cont???? and also my funeral testamentary and all other expences relating to or incidental to the performance of the trusts and bequests of this my will and also from and out of the said purchase money as far as the same will extend to raise the sum of one thousand pounds of lawful British money free and clear of all legacy duty and other drawbacks whatsoever and pay the same immediately on my decease into the hands of my brother the Reverend John Pyke to and for the use of the said John Pyke his executors and administrators with lawful interest for the same until paid and to take proper receipts and discharges for the same save and except any debt by bond note or otherwise which may be due from me to my said brother Thomas Pyke at my decease and for which I have hereinbefore given him a compensation in lieu thereof in case he chuses to accept the same and if not then out of such monies to discharge such debt as well as all my other debts or so far as the same will extend And in case the produce of such sale or sales shall be more than sufficient to discharge such debts legacy and expences and interest thereon then upon trust to pay over or suffer the residue to be retained by the said Thomas Pyke his executors or administrators to and for his and their own use and benefit and to for and upon no other use trust intent and purpose whatsoever Provided always and my will and desire is that in case the said Thomas Pyke and Richard Welford should be desirous of purchasing both or either of my said farms at Olney and Emberton otherwise Emmerton aforesaid then I do hereby empower and allow them so to do at a fair price and the purchase money to be applied as before mentioned and I hereby give to the said Thomas Pyke the first selection of purchasing one of the said estates and in case the said Richard Welford should decline purchasing after such selection made then my will is that the said Thomas Pike shall be at liberty to purchase both or either of the said estates and for faclitating such sale or sales my will is that the receipt of the said Thomas Pyke and Richard Welford or the survivor of them and the heirs and assigns of such survivir his exors or administrators shall from time to time be a good and sufficient discharge to the purchaser or purchasers of all or any part of my last mentioned tenements and hereditaments and premises and to his her or their respective heirs executors or administrators for so much of such purchase money as shall therein be acknowledged to be received and that such purchaser or purchasers his or her heirs executors or administrators shall not afterwards be answerable or accountable for any loss or missapplication of such purchase money so received or any part thereof And as to for and concerning all that my capital freehold messuage or tenement and farm called Wick Farm together with the several closes pieces and parcels of arable meadow pasture down & wood lands and grounds therewith occupied with the rights members and appurtenances thereto belonging and now in my occupation situate in the several Parishes of Pewsey aforesaid and Milton in the said County of Wilts ?????r both of them and also all those several ?? cottages or tenements with the gardens and appurts thereto belonging situate in the said Parishes of Pewsey and Milton and now in the respective occupations of Thomas Martin John Fibbence and Henry Hailstone And also all that my freehold messuage or tenement and Farm called Dagnall Farm with the several closes pieces and parcels of arable meadow pasture down ley and wood lands and grounds therewith occupied with the rights members and appurtenances to the same belonging and which are now in the occupation of Susannah Ginger or her undertenants and are situate in the several parishes present or places of Dagnall Eddlesborough Leighton Buzzard and Studham or some or one of them in the Counties of Bucks Bedford and Hertford or in some or one of them And also all that my Copyhold messuage or tenement and farm with the several Copyhold cottages tenements and gardens thereon being called Burcott Farm together with the several closes pieces and parcels of Copyhold arable meadow pasture and ley grounds lands and woods therewith had with their rights members & appurts thereto belonging situate in the precincts or places of Burcott otherwise Crofton and Wing in the Parish of Wing and County of Bucks aforesaid and now in the occupations of Thomas Adams or his undertenants and all which I have surrendered to the uses of my Will and also all those my several freehold closes pieces and parcels of arable meadow pasture and ley lands and grounds with their rights members and appurtenances situate at Murseley in the said County of Bucks and now in the occupation of samuel Simmons or his undertenants And also all those my several pieces or parcels of freehold land and grounds called the Fresh marshground situate at East Hamm in the County of Essex with their rights members and appurtenances and now in the occupation of William Turner Gentleman I give and devise the same last mentioned and devised messuages cottages farms lands tenements hereditaments and premises with their and every of their rights members and appurtenances unto the said Thomas Pyke and Richard Welford and the survivor of them and the heirs and assigns of such survivor To hold unto & to the use of the said Thomas Pyke and Richard Welford and the survivor of them and the heirs and assigns of such survivor for ever upon the several trusts nevertheless and to and for the several ends intents and purposes and with under and subject to the several powers provisoes & declarations hereinafter limited expressed and declared of and concerning the same that is to say upon trust to stand seized thereof and to receive the rents issues and profits thereof In the first place from and out of the rents issues and profits of all that my capital messuage or tenement and farm called Wick Farm with the rights members and appurtenances thereto belonging to raise one annuity or clear yearly sum of fifty two pounds of lawful British money free of legacy duty & all other outgoings whatsoever and to pay the same into the proper hands and for the sole use & benefit of Julienne Hillier of North Newton in the said County of Wilts Spinster by equal weekly portions of twenty shillings for and during the term of her natural life and her receipt alone and independent of the controul or engagement of any persons she may hereafter marry shall be to my trustees their full and sufficient discharge And in case my said freehold estates situate at Alney and Emberton otherwise Emmerton aforesaid and hereinbefore by me directed to be sold for the liquidation of my debts and interest thereon funeral testamentary and other expences and legacy to the said John Pyke shall be insufficient to pay and discharge the same then upon trust from time to time to pay over and apply so much of the rents issues and profits of all my said last mentioned hereditaments and premises subject to such annuity as aforesaid in discharge of the residue of all my said debts and interest thereon funeral testatmentary and other expences and legacy to the said John Pyke as aforesaid and from and immediately after the same shall have been liquidated and proper discharges given Then upon trust as for and concerning all that the aforesaid capital messuage tenement and farm with the several closes pieces and parcels of arable meadow pasture down & wood lands and grounds thereto belonging called Wick Farm with their rights members and appurts and also all those the said several cottages or tenements with the gardens and appurtenances situate in Pewsey and Milton aforesaid to convey assign and assure the said last mentioned hereditaments and premises and every part thereof with their rights members and appurtences unto and to the only proper use and behoof of my nephew Thomas Henry Pyke the eldest Son of my brother Thomas Pyke to hold to him the said Thomas Henry Pyke his heirs and assigns for ever and to for and upon no other use trust intent or purposes whatsoever and as for and concerning all that the aforesaid messuage tenement or farm called Dagnall Farm with the several closes pieces and parcels of arable meadow pasture down ley and wood lands and grounds thereto belonging with their rights members and appurtenances upon trust to pay the rents issues and profits thereof by equal half yearly payments into the proper hands and for the sole benefit it my sister Sarah wife wife of the said Richard Welford independent of the controul or engagements of her said husband for and during the term of her natural life and from and immediately after her decease to convey assign and assure the said last mentioned hereditabments and premises and every part thereof with their rights members and appurtenances unto and to the only proper use and behoof of my nephew Henry Pyke Wldford second son of the said Sarah and Richard Welford To hold to him the said Henry Pyke Welford his heirs and assigns forever And to for and upon no ohter use trust intent or purpose whatsoever And as for and concerning all that the aforesaid Copyhold messuage or tenement and farm with the several Copyhold cottages tenements and gardens thereon being called Burcott Farm together with the several closes pieces and parcels of Copyhold arable meadow pasture ley lands grounds and woods thereto belonging with their rights members & appurtenances situate in Burcott Wing and Croften aforesaid And also all those the aforesaid several freehold closes pieces and parcels of arable meadow pasture and ley lands and grounds situate in Mursley aforesaid with their rights members and appurtenances and also all those the aforesaid freehold several pieces or pacels of land called Fresh marsh ground situate in EAst Hamm aforesaid with their rights members and appurtenances to convey assign and assure the same and every part thereof unto and to the only proper use and behoof of my said brother Thomas Pyke To hold to him the said Thomas Pyke his heirs and assigns for ever provided always and my will is nevertheless that such last mentioned devise to my said brother Thomas Pyke and his heirs is upon this express condition that unless the said Thomas Pyke his executors or administrators shall within three months next after my decease release all & every sum and sums of money which I may stand indebted to him or them at my decease and all interest interest thereon And in case he or they shall refuse or neglect so to do then upon trust that my said trustees shall after such refusal or neglect as aforesaid convey assign and assure All and singular the said hereditaments and premises so lastly hereinbefore devised to the said Thomas Pyke his heirs and assigns unto and to the only proper use and behoof of my nephew the said Thomas Henry Pyke his heirs and assigns forever and to for and upon use trust intent or purpose whatsoever I give and bequeath unto my nephew the said Thomas Henry Pyke All and singular my household goods and implements of household plate jewels linen woollen china wines beers and other liquors which may be in or about my dwelling house at the time of my decease and also all and singular my farming stock cattle and crops severed or unsevered implements of husbandry and all other matters effects and things on my farm at Wick aforesaid at the time of my decease To hold the same unto my said nephew Thomas Henry Pyke his executors and administrators absolutely And as for and concerning all the rest residue and remainder of my personal estate and effects whatsoever wheresoever and of what nature or kind soever I give and bequeath the same and every part thereof unto my Executors hereinafter named upon trust to be converted into money and in the first place to be applied in part liquidation of my debts and interest thereon funeral testimentary and other expences as aforesaid And I hereby declare my will to be that it shall and may be lawful to and for my said trustees and any new trustee or trustees and my Executors hereinafter appointed and their respective heirs executors and administrators by and out of all or any part of the monies which by virtue of this my will or any trust therein declared shall come to their or any of their hands to deduct retain to and reimburse themselves all such reasonable costs charges and expences as they or either of them shall or may respectively sustain expend or be put unto in or about the execution of this my will and also then they my said Trustees and Executors their respective heirs executors and administrators shall be charged and chargeable only every of them for and with his her or their respective receipts payments acts and wilful defaults and not otherwise and shall not be charged or chargeable with or for any sum or sums of money other than such as shall actually and resp????ly come to his her and their hands by virtue of this my will nor with or for any loss or damage which may happen in or about the execution of all or any of the trusts hereby in them reposed with out his her or their wilful defaults provided always and it is my will and desire that if the said Thomas Pyke and Richard Welford oreither of them shall die or be desirious of being discharged or and from or refuse decline or be incapable to ??? in the trusts hereby in them reposed or in the execution or exercise of the powers or authorities hereby vested in them before such trusts shall be fully executed performed and discharged it shall and may be lawful to and for the said Thomas Henry Pyke together with either of my said trustees who may continue to act or if both should be dead or decline ???ing then of his own accord to nominate substitute and appoint any other person or persons to be a trustee or trustees in the place and stead of any such trustee and trustees so dying or desirous to be discharged or refusing declining or becoming incapable to act as aforesaid and that when and so often any new trustee or trustees shall be nominated or appointed as aforesaid all the trust estates monies and premises of or unto which or on account whereof such new trustee or trustees shall be so nominated and appointed shall be thereupon with all convenient speed conveyed assigned and transferred in such ???? manner and form and so that the same shall be legally and effectually vested in the surviving or continuing trustee or trustees and such new or other Trustee or Trustees or if there shall be no continuing trustee of the same trust estates monies & premises then in such new trustees only to the same uses upon the same trusts as are hereinbefore declared & expressed of and concerning the said trust estates ?????s and premises respectively or wuch of them as shall or may be then subsisting or capable of taking effect and I do hereby nominate & appoint my said brother the said Thomas Pyke and the said Richard Welford to be joint Executors of this my will hereby revoking all former wills by me at any time heretofore made I declare this and this only to be my last Will and Testament In witness whereof I have to this my said last Will and Testament contained on eight sides of paper to the seven first sides thereof set my I give and bequeath unto my brother Thomas Pyke and my brother in law Richard Welford Trustees and Executors in my said will named the full sum of four hundred pounds of lawful British money free of legacy duty and all other drawbacks whatsoever Upon trust to invest the same in his and their names or the name of the survor of them upon real or Government security so soon as the same can be raised after my decease and to pay and apply the interest dividends and proceeds thereof by two equal half yearly payments for and towards the maintenance and education of my nephew Henry Pyke eldest son of my brother William Pyke during the term of his minority and when he shall attain the age of twenty one years then upon trust to pay assign and transfer the said principal money or the stocks funds and securities whereon the same shall be placed and all interest thereon due unto the said Henry Pyke his executors and administrators And in case the said Henry Pyke shall not attain his said age of twenty one years upon trust to pay the interest dividends and proceeds thereof in equal proportions and by half yearly payments for and towards the maintenance and education of all and every such ohter child and children of the said William Pyke by Sophia his present wife who shall not have attained the age of twenty one years during his her or their respective minorities and so continue until every such child shall have attained the age of twenty one years and when the last or only surviving child if all but one shall die shall have attained such age upon trust to pay or transfer the whole of the said principal money stocks funds & securities and all interest due thereon equally unto and amongst all and every the child or children if more than one survive of the said William Pyke as aforesaid who shall have attained his her or their res??ive age of twenty one years and be then living or to such only surviving child but if all such children shall die under the age of twenty one years I direct the said legacy shall lapse into my personal estate I give and bequeath unto my sister Elizabeth Pinkley the sum of three hundred pounds of lawful British money free of legacy duty and all other outgoings I also give and bequeath unto my Sister Jane the wife of Joseph Silber Esquire the like sum of three hundred pounds of like lawful money free of legacy duty and other charges and I do hereby charge the three last mentioned pecuniary legacies upon all my freehold copyhold and leasehold estates in my will limited for the purposes of raising a fund for the discharge of my debts and legacies by me given in case my personal estate not specifically bequeathed shall be insufficient to raise and discharge the same and whereas I have in and by my said will and Testament bearing date on or about the fifteenth day of November one thousand eight hundred and twenty three devised unto Julienne Hillier of North Newnton in the said County of Wilts Spinster one annuity or clear yearly sum of fifty two pounds payable by weekly installments Now in addition to the said annuity I do hereby charge all that my capital messuage or tenement and farm called Wick Farm with the rights members and appurtenances thereto belonging situate in the Parish of Pewsey in the County of Wilts and now in my occupation with one further annuity or yearly sum of twenty eight pounds free of all legacy duty and all other drawbacks I give the same unto and for the benefit of the said Julienne independent of the controul or engagements of any husband she may hereafter intermarry with And I direct the said Thomas Pyke and Richard Welford and the survivor of them his heirs executors and administrators to raise the said last mentioned annuity of twenty eight pounds from and out of my said last mentioned estate and pay the same over unto the said Julienne Hillier whose receipt alone shall be to my Trustees their sufficient discharge as well also as the first hereinbefore mentioned annuity or yearly sum of fifty two pounds by equal two monthly payments in every year of six pounds thirteen shillings and four pence each instead of weekly payments as in my said will mentioned touching the said first mentioned annuity of fifty two pounds per annum by my said will given to the said Julienne Hillier and whereas I have in and by my said last will and Testament given and devised all that my freehold messuage tenement or farm called Dagnal Farm with the several closes pieces and parcels of arable meadow pasture doen ley and wood lands and grounds to the same belonging with their rights members and appurtenances situate at Dagnal in the Parish of Sa lesborough in the County of Bucks Studham and Leighton Buzzard in the Counties of Bucks and Bedford or one of them and now in the occupation of Susannah Ginger or her undertenants after certain limitations thereof in my said will mentioned unto the said Thomas Pyke & Richard Welford upon trusts to pay the rents issues and proceeds thereof unto my sister Sarah the wife of the said Richard Welford for and during the term of her natural life with the remainder in fee to my nephew Henry Pyke Welford second son of the said Sarah and Richard Welford Now I do confirm the estate for life to my said Sister Sarah Welford but revoke the devise to the said Henry Pyke Welford in my said Will mentioned and instead and in lieu thereof from and after the decease of the said Sarah Welford I give and devise the said messuage or tenement and farm lands and hereditaments with their rights members and appurtenances unto the said Thomas Pyke and Richard Welford and the survivor of them his heirs and assigns for ever But nevertheless to upon and for the uses trusts intents and purposes and with under and subject to the powers provisoes conditions and limitations hereinafter mentioned and expressed of and concerning the same that is to say to the use of the said Henry Pyke Welford for and during the term of his natural life without impeachment of waste and from and after the determination of that estate tot he use of the said Thomas Pyke and Richard Welford and the Survivor of them and the?? heirs of such survivor during the life of the said Henry Pyke Welford upon trust to spuport and preserve the contingent uses and estates hereinafter limited from being defeated and destroyed and for that purpose to make entries and bring actions as occasion may require but nevertheless to permit and suffer the said Henry Pyke Welford and his assigns to receive and take the rents issues and profits of the said heredits & premises for and during the term of his natural life without impeachment of waste to and for his and their own use and benefit and from and immediately after the decease of the said Henry Pyke Welford to the use of the first second third fourth and all and every other the sons and sons of the body of the said Henry Pyke Welford lawfully to be begotten severally successively and in remainder one after another as they and every of them shall happen to be in priority of birth and of the several and respective heirs male of the body and respective bodies of all and every such son and sons lawfully issuing the elder of such sons and the heirs male of his body issuing being always prefered and to take before the younger of the same sons and the heirs male of his and their bodies issuing and for default of such issue to the use of all and every the daughter and daughters of the body of the said Henry Pyke Welford lawfully to be begotten if more than one as tenants in common and not as joint tenants and in default of such issue to the use of my niece Sarah Welford the eldest daughter of the said Sarah and Richard Welford and her assigns during the term of her natural life without impeachment of waste and after the determination of that estate by forfeiture or otherwise in her life time to the use of the said Thomas Pyke and Richard Welford and the survivor of them and the heirs of such survivor upon trust to support and preserve the contingent uses and estates hereinafter limited from being defeated and destroyed and for that purpose to make entries and bring actions as occasion may require but nevertheless to permit and suffer the said Sarah Welford the younger and her assigns to receive and take the rents issues and profits of teh said hereditaments and premises for and during the term of his natural life to and for her and their own use and benefit and from and immediately after the decease of the said Sarah Welford the younger to the use of the first second third fourth and all and every other the son and sons of the body of the said Sarah Welford the younger lawfully to be begotten severally successively and in remainder one after another as they and every of them shall happen to be in priority of birth of the several and respective heirs male of the body and respective bodies of all and every such son and sons lawfully issuing the elder of such sons and the heirs male of his body being preferred and to take before the younger of the same sons and the heirs male of his and their body and bodies issuing And for default of such issue to the use of all and every the daughter and daughters of the body of the said Sarah Welford the younger lawfully to be begotten if more than one as tenants in common and not as joint tenants and for default of such issue to the use of my nephew Frederick Welford third son of the said Richard and Sarah Welford his heirs and assigns for ever Provided always and my Will is that the said Henry Pyke Welford and all and every other tenant or tenants for life or in tail shall be at liberty to charge by writing under his or their respective hand and seal the said hereditaments and premises with one clear rent charge or yearly sum not exceeding fifty pounds per annum as and for a provision for any woman such tenant for life or in tail may happen to marry and I give the full power for recovery of such rent charge in all other respects I do hereby ratify and confirm my said last Will and Testament In witness whereof I have to this my said Codicil contained in five sheets of paper to the first four sheets in the Parish of Pewsey in the County of Wilts Esquire Do declare this to be a Codicil to my last Will and Testament and desire the same may be proved therewith whereas I have by a Codicil to my last Will and Testament dated the second day of January 1824 given and bequeathed unto my brother Thomas Pyke and my brother in law Richard Welford Trustees in my Will named the sum of four hundred pounds of lawful British money upon trust to invest the same upon real & Government Security and to pay and apply the interest and dividends thereof for the maintenance and education of my nephew Henry Pyke eldest son of my brother William Pyke during his minority and to pay the said principal sum when he shall attain the age of twenty one years and in the event of his decease before attaining such age Upon trust to pay such interest and dividends in equal portions as therein mentioned for the maintenance and education of all and every such other child and children of the said William Pyke by Sophia his present wife as therein mentioned with several other trusts as in my said Codicil mentioned relating thereto Now I do hereby revoke and absolutely make void such bequest or legacy of four hundred pounds and all the trusts thereupon resulting and instead and in lieu thereof I give and bequeath unto the said Thomas Pyke and Richard Welford and the survivor of them his executors and administrators the sum of four hundred pounds of lawful money free of ??? legacy duty and all other drawbacks and to be raised within six months next after my decease Upon the following trusts that is to say upon trust from and out of the rents and profits of the several hereditaments in my will appointed to raise a general fund for the purposes therein mentioned to raise the said sum of four hundred pounds and invest the same upon Government or real security and from time to time to change and reinvest the same in similar security as occasion may require and to pay and apply the dividends and interest therefrom to arise unto and for the maintenance and education of my nephew Leopold Pyke second son of my brother William Pyke for and during his minority and when he shall have attained the age of twenty one years upon trust to pay and divide the principal of such stocks funds and securities in the following proportions that is to say as to two third parts thereof unto the said Leopold Pyke for his absolute use and as to teh remaining one third part thereof unto the said Henry Pyke eldest son of the said William Pyke for his absolute use and in the event of either of my said nephews dying before they attain the age of twenty one years then I direct the survivor attaining such age shall take the whole of such stocks funds and securities adn the accumulations thereof if any and in the event of both dying under the age of twenty one years then I direct such stocks funds and securities shall fall into my residuary personal estate and in all other respects I ratify & confirm my said Will and Codicil In witness whereof I the said Henry Pyke the testator have to this my Codicil contained in one sheet of paper set my hand and seal this twentieth day of November in
