15 December 1792 Will of Elizabeth Pyke of Devizes Green, Bishops Cannings, Wiltshire, widow (proved 9 March 1793)

Considering the uncertainty of 
Death and the uncertainty of the time thereof and
being in an indifferent State of Bodily Health but 
(blessed be god) of a sound and disposing Mind Memory and
understanding I Elizabeth Pyke of Devizes Green in the
Parish of Bishops Cannings in the County of Wilts Widow
do make ordain and Publish this to be my last will and
Testament in manner and form following (that is to say)
I Give and Bequeath unto my Sister Hester Wife of
William Miall of All Cannings the Sum of one hundred
Pounds of good and lawful Money of Great Britain Also
I Give and Bequeath unto my Nephew William Miall
the Sum of Fifty Pounds of like Money with my Silver
bell??? Pint and one Silver Table Spoon Also I Give and
Bequeath to my Nephew John Hamblen of Stanton 
Bernard the Sum of one hundred and Fifty Pounds and
my Silver Quart Mug two Silver Table Spoons my Stone
Show and Knee Buckles and also my Silver Mock
Buckle and Mahogany Bureau Also I Give and 
Bequeath to Elizabeth Hamblen Daughter of my
aforesaid Nephew the Sum of Fifty Pounds and my Silver
Shoe Buckles Also I Give and Bequeath to my Niece
Sarah Pyke Daughter of my late Husband's Brother
John Pyke Deceased the Sum of ten Pounds to Elizabeth
Pyke of Horton the Sum of five Pounds To the six
Children of my Nephew Nathaniel Pyke late of
Woolwich Deceased the Sum of Fifty Pounds to be equally
Divided between them To my Niece Bridget Pyke and


Cousin Ann Perry the sum of ten pounds each 
  To my Cousins Martha and Ann Tarrent of
Devisee Green the Sum of Five Pounds each To my
esteemed Friend Elizabeth Haywood of Devisees aforesaid the
Sum of twenty Pounds to my esteemed Friend Mrs Mary
Hynd of Clerkenwell London the Sum of ten Pounds and
to the Four Children of my said Friend Mary Hynd namely
Samuel Mary Martha and Elizabeth Armstrong the Sum
of five Pounds each to Thomas Hayward Son of my Friend
Robert Hayward of Roundway my Silver Tankard to Mr
Charles Fitchin the Elder of Roundway the Sum of one
Guinea to buy him a Ring and also my late Husbands
Freemasons Medal and the Great Harp thereto belonging
to my Nephew Simon Miall I Give my best flock Bed and
Bolster my second best bed Quilt one pair of Blankets
and my Blue Curtains all which adoresaid several and
respective Pecuniary and specific Legacies I Will and direct
shall be paid to my said respective Legatees by my said 
Executors hereinafter named withine six Calendar Months
next after my Decease Also I Give and Bequeath to
Elizabeth Stevens wife of John Stevens of Horton Mason
the Sum of twenty Pounds with two Pewter Dishes and six
plates to Jane Pound wife of John Pound of Bedborough
Lane Husbandman the Sum of five Pounds To my Cousin
Sarah Pierce wife of William Pierce of New Sarum the
like Sum of Five Pounds which said three last mentioned 
Legacies I Will and direct shall be paid by my said
Executors after named into the hands of them the said
Elizabeth Stevens Jane Pounds and Sarah Pierce to and
for their several and respective sole and seperate use and 
benefit notwithstanding their respective Covertures within
six Calendar Months next after my Decease and that
their Receipts alone without their respective Husbands shall
be sufficient discharges for the same Also I Give and
Bequeath unto my esteemed Friends Richard Chandler of
Devisees Green aforesaid and Robert Hayward of Roundway
aforesaid Gentleman their Executors and Admors the Sum of
three hundred Pounds of like lawful Money aforesaid to 
for and upon the several Trusts intents and purposes 
hereinafter mentioned expressed and declared of and concerning 
the same (that is to say) that they the said Richard 
Chandler and Robert Hayward or the Survivor of them or
the Executors or Admors of such Survivor do and shall as
soon as conveniently may be after my Decease pay the
said Sum of three hundred Pounds unto or between such
person or persons either in time or in such parts and proportions 
or disproportions at such time or times for such uses intents 
and purposes and in such manner and form as my Niece
Amy Wesson Wife of William Wesson late of all Canons
aforesaid Shopkeeper shall whether Covert or Sole and 
notwithstanding her said Present Coverture or any Future
Coverture she shall or may be under by and Deeds 


or Deed in writing revokable or irrevokable under her 
hand and Seal to be duly executed in the presence of
and be attested by two or more Credible witnesses or by
any Note order or direction or notes orders or Directions
under her hand alone by her Signed in the presence of
and attested by two or more such witnesses or by her last
Will and Testament or Testamentary Disposition or appointment
also in writing or any writing in the nature thereof or
purporting so to be under her hand and Seal or under
her hand alone by her executed or Signed in the presence
of and attested or witnessed by two or more such witnesses
limit and appoint order direct Give or Bequeath the same
or any part or parts thereof and for want of and until
such limitation appointment order or direction as aforesd
of her the said Amy Wesson to take place in her
Life time of the said Sum of three hundred Pounds 
or any part or parts thereof as touching the same
Sum of three hundred Pounds or such part or parts 
thereof of which no such limitation appointment order
or Direction shall be by her made upon Trust that
they the said Richard Chandler and Robert Hayward
or the Survivor of them or hte Executors or Admors of
such Survivor do and shall from time to time during the
natural Life of her the said Amy Wesson put place
and Continue the same or any such part or parts
thereof as she shall think proper out at Interest on
such Security or Securities either Real or Personal as
she shall  (whether Covert or sole as aforesid) consent
unto or approve of direct or appoint and do and shall
pay the Interest and Dividends and profits from time
to time arising therefrom as the same shall be received 
unto her the said Amy Wesson into her own proper hands
otherwise at her sole election and Choice) permit and
suffer her alone to receive and take the same Interest
Dividends and Profits to and for her own sole and seperate
use benefit advantage and disposal as her seperate 
property and Estate apart from and independent of her 
said present Husband the said William Wesson or any
other Husband or Husbands with whom she shall or
may hereafter intermarry and to the intent that the
same may not be at the disposal of or subject or
liable to the Controul Debts or Engagements of her
present Husband or any such Future Husband or Husbands 
and the Receipts and acquittances of her the said Ann
Wesson under her own her own hand alone whether
Covert or sole and notwithstanding her present Coverture
or any such Future Coverture as aforesaid shall be
alone from time to time a good and sufficient discharge 
and from and after the Decease of her the said Amy
Wesson she having made no such limitation appointment
order direction Gift or bequeast of the said Sum of three
hundred Pounds
  then in trust that they
  my said Trustees as 
  aforesaid do and
  shall pay the said
  sum of three hundred
  pounds
  or such undisposed or applied part or


parts thereof with its interest Dividends and Profits unto the
Executors or Admors of her the said Amy Wesson to and for
his and their own proper use and benefit and upon to or
for no other Trust use intent or purpose whatsoever Also I
Give Devise and Bequeath unto the said Richard Chandler
and Robert Hayward their Heirs Executors and Admors all
those three Messuages or Tenements with their Appurts thereto
belongong situate and being in Devizees Green aforesaid and 
respectively in the Occupation of myself Joseph Lott and John
Player and also all the Rest and Residue of my Household
Goods Furniture and Implements of Household of every sort
and kind & wearing Apparel both Linnen and woollen To hold
the same Messuages or Tenements and Appurts Household
Goods and Wearing Apparel unto them the said Richard 
Chandler and Robert Hayward their Heirs Executors and
Admors for and during all my estate Right Title and
Interest respectively therein upon Trust and to and for the
several and like uses intents and Purposes and with under
and subject to the several and like powers Provisions and 
Agreements as are mentioned and declared of and concerning 
the said Sum of three hundred Pounds hereinbefore given In Trust for her
my said Niece Amy Wesson or such and so many of them
as are or may be Capable of taking Effect or the nature 
of the respective last Bequests will admit of and to for or
upon no other use Trust intent or purpose whatsoever and
as to for and Concerning all the rest and residue and remainder 
of my Goods and Chattels Monies Debts and Securities or
Money and all other my Personal Estate and Effects
whatsoever and wheresoever or of what nature or kind
soever and not otherwise by this my Will before given or
disposed of (after payment of my Just Debts Legacies Funeral
Expences and the Charges of proving this my Will and other
incident disbursement I Give and Bequeath the same and
every part thereof unto my said Nephew the said Simon
Miall his Executors Admors and Assigns for ever to and for his
and their own proper use and benefit and it is my Will
and I do hereby authorize and empower them my said
Trustees and Executors in Trust and the Survivor of them
and the Executors or Admors of such Survivor out of the 
aforesaid Trust Monies and Estate in the first place to
pay and reimburse themselves respectively all the lawful
Costs Charges and Expences which they respectively shall
or may be at or put unto for or by reason of the said
Trusts hereby in them reposed or any or either of them
or the Management or Execution thereof and that they
or either of them shall not be answerable for or liable
to make good any loss or losses which shall or may
happen to the said Trust Monies Estates or any Part or
parts thereof save such only as shall or may be occasioned
by or through their own respective wilful neglects or Defaults 
or be answerable or Accountable for any more of the said
Trust Monies and Estates than they respectively shall


actually receive or which shall come to their own respective
hands neither shall either or any of them be answerable
or Accountable for the Acts Receipts Defaults of the
other or either or any other or others of them but each 
of them for his and their own respective Acts Receipts 
and Defaults only and I do make ordain Constitute and
appoint my good Friends the said Richard Chandler and 
Robert Hayward Joint Executors in Trust of this my last
will and Testament which I declare hereby so to be and 
revoke and make void all former and other wills by me
at any time made and I do Give and Bequeath unto
them my said Friends Richard Chandler and Robert
Hayward the Sum of five Guineas each as some recompence
and Compensation for the Trouble they must have and
necessarily take in the Discharge of the Trustee and
Executorship of this my Will In Witness whereof I the
said Elizabeth Pyke have to this my last Will and
Testament contained in these Four sheets of paper wrote
on one side of each sheet and affixed together to the
first three sheets thereof I have set my hand and to
this Fourth and last my hand and Seal this Fifteenth
Day of December in the year of our Lord one thousand 
seven hundred and ninety two  The Mark and Seal of Elizabeth

said Testatrix as and for her last will and Testament
in the presence of us three who at her request in her
presence and in the presence of each other have hereunto
subscribed our names as witnesses  Martha Hering  Mary

This Will was proved at London the ninth Day
of March in the year of our Lord one thousand seven hundred
and ninety three before the Right Honourable Sir William
Wynne Knight Doctor of Laws Master Keeper or Commissary
of the Prerogative Court of Canterbury lawfully constituted 
by the Oaths of Richard Chandler and Robert Hayward 
the Executors named in the said Will to whom Administration
of all and singular the Goods Chattels and Credits of the 
Deceased was granted having been first sworn by Commission
duly to Administer
