Instructions for the will of Elizabeth Pyke of Bretts Buildings Camberwell Surrey I direct the payment of my just debts I give and bequeath unto my Sister Mary Ann Norman widow now residing with me all my Capital Stock or fund in the Long Annuities that I may die possessed of now producing the sum of L102 per annum absolutely free from the debts controul or engagement of any future husband I also give and bequeath unto my said sister Mary Ann Norman all my household furniture plate linen and other effects in the house in which I now reside also the Lease of the house at the corner of Bowyer Lane now occupied by Mrs Knox and all benefit thereof I give and bequeath unto my two brothers James Edney and George Edney the sum of two hundred pounds money each I give and bequeath unto between and amongst my six nephews and neices William Edney James Edney William Norman Henry Norman Jane Edney and Edward Edney All the Rest Residue and Remainder of my property and money in the funds equally share and share alike to be paid to them respectively on attaining the age of 21 years with benefit of survivorship in case of any dying under that age And I appoint my sister Mary Ann Norman and my brother James Edney Executrix and Executor of this my will Dated this 27th day of April 1833 E Pike Witness Jas Shelton Newbon John Browne In the Goods of Elizabeth Pike widow decd Appeared Personally James Shelton Newbon of Great Carter Lane in the City of London Gentleman and John Browne of Saint Georges place Camberwell in the County of Surry Surgeon and being sworn to depose the truth made Oath as follows and first the said John Browne for himself saith that he was the Medical Attendant of Elizabeth Pike late of Bretts Buildings Camberwell in the County of Surry Widow deceased during her last illness and apprehending such illness might prove fatal caused the Deponent James Shelton Newbon to be sent for on the twenty seventh day of April last with the assent of the said deceased to take instructions for and prepare her will and deponents James Shelton Newbon and John Browne severally say that he the said James Shelton Newbon attended accordingly at the house of the said deceased about the hour of seven o'Clock in the Evening of the said twenty seventh of April and then received verbal instructions from the said deceased for preparing her will in the presence of the said John Browne and they further say that such instruction were reduced into writing in the presence of the deceased and then read over audibly and distinctly to her and she well knew and understood the contents thereof and approved of the same that the said deceased being in a very weak and exhausted state and expected that she could not live more than a few hours she executed the said Instructions and declared the same to be her last Will and Testament in the presence of these Deponents who at her request signed their names as witnesses thereto attesting the execution thereof And they further say that the said deceased was at and during the said time of sound mind memory and understanding and well knew and understood the con- tents of the said will and what she said and did and what was said and done in her presence and was capable of making and executing her last Will and Testament or of doing any other Act of that or the like nature requiring thought Judgment and reflection and they further say that they have been informed and verily believe that the said deceased departed this life about the hour of one o'Clock in the morning of the day following to wit the twenty eighth day of April last and these deponents having carefully inspected the paper writing now hereunto annexed beginning thus "Instructions for the will of Elizabeth Pike of Bretts Buildings Camberwell Surry" ending thus "Dated this 27th day of April 1833" and subscribed thus "E Pike" and having particularly observed the name "Norman" in the first line of the names "Edward Edney" in the twenty third line the word "share" in the twenty fifth line and the whole of the twenty sixth twenty seventh twenty eighth twenty ninth thirtieth thirty first and thirty second lines obliterated therein and having also particularly observed the names "William Edney" inserted between the twenty second and twenty third lines thereof they say that the said obliterations and insertions were made as they now appear with the knowledge and approbation of the said deceased previously to the execution of the said will Jas Shelton Newbon The 25th day of May 1833 the said James Shelton Newbon was sworn to the truth of this Affidavit Before me W C Curteis Surr Present G S Heales Not Pub John Browne Same day the said John Browne was duly sworn to the truth of this Affidavit Before me W C Curteis Surr Present G S Heales Not Pub Proved at London 26th June 1833 before the Worshipful Charles Coote Doctor of Laws and Surrogate by the Oaths of Mary Ann Norman Widow and James Edney the Sister and Brother of the said deceased the Executors to whom Admon was granted having been first sworn duly to administer George Edney also the Brother of the said deceased who together with the said Mary Ann Norman widow and James Edney and William Edney and James Edney respectively Minors the Newphews of the said deceased the only persons who would have been entitled (in distribution) to the personal Estate and Effects of the said deceased had she died Intestate having first consented as by Acts of Court appears on the 12th day of February 1859 Letters of administration with the Will annexed of all the personal estate and Effects of Elizabeth Pike late of Bretts Buildings Camberwell in the county of Surrey widow deceased who died on the 28th day of April 1833 at Bretts Buildings aforesaid left unadministered by Mary Ann Norman widow the Sister and James Edney the Brother respectively deceased whilst living the Executors named in the said Will were granted to William Edney the Nephew and one of the Residuary Legatees named in the said Will he having been first sworn duly to administer the said James Edney ????? ?????his CoExecutor and died Intestate George Edney the Brother also of the said deceased who together with the said Mary Ann Norman widow and James Edney and William Edney and James Edney (respectively Minors) the nephews also of the said deceased the only persons who would have been entitled in distribution to her personal Estate and Effects of the said deceased had she died Intestate having heretofore consented
