I Robert Tito the Elder of the Town and
County of Poole Gentleman being weak of Body but of sound
and perfect Memory and Understanding thanks be therefore
rendred to Almighty God considering the uncertainty of
time and the certainty of Mortality Do (in the fear of God)
make and ordain this my last Will and Testament (that is
to say) principally and First of all I recommend my Soul
to the hands of God who gave it and my Body to the Dust
and as touching such Worldly Estate wherewith it hath
pleased God to Endow me (after my Debts and Funeral
Expences are paid and discharged) I give devise and
dispose of the same in manner and form following (that
is to say) First of all I give devise and bequeath unto my
loving Daughter Elizabeth Durell of the said Town and 
County of Poole Widow all that my Messuage Tenement 
or Dwelling House with its appurtenances scituate lying
or being within the Parish of Stourminster Marshall in
the County of Dorset now in the Tenure or Occupation of
Thomas Lawes together with all Houses Outhouses Edifices
Building Backsides Gardens Grounds Closes Meadows



Pastures Lands and all singular other the premises and
Appurtenances to the said Messuage Tenement Dwelling
House and Estate belonging or in any wise appertaining for
and during the Term of her natural Life my said Daughter
paying out of my said Estate of the Rents Issues and Profits
thereof unto my loving Wife Joan Tito the Sum of Seven
pounds Sterling by the year Quarterly during the Life of my
said Wife and I do hereby Charge the said Estate therewith
To have and to hold the said Messuage Tenement or Dwelling
House Outhouses Lands Premises and Appurtenances unto
my said Daughter Elizabeth Durell for and during the Term 
of her natural Life she paying out of it to my said Wife as
aforesaid And from and after her decease I give grant devise
and confirm the said Messuage Tenement or Dwelling
House Outhouses Edifices Buildings Backsides Gardens Grounds
Closes Lands and all and singular the Premisses Hereditaments
and Appurtenances thereunto belonging unto my loving
Grandson Tito Durell and to the Heirs of his Body lawfully
begotten and to be begotten forever Also I give grant and
devise unto my said Loving Wife Joan Tito all that my
Messuage Tenement or Dwelling House with its appurtenances
scituate standing lying or being within the Town and
County of Poole aforesaid in a Street there common called
by the Name of Garden Street together with the Lands
Outhouses Garden and Appurtenances thereunto belonging
now in my possession and occupation for and during the
Term of her natural Life To have and to hold the said
Messuage Tenement or Dwelling House with all and singular
other the Premisses and Appurtenances thereunto belonging
unto my said Wife Joan Tito for and during the Term of
her natural Life and from and after her decease I give
grand and devise the said Messuage Tenement or Dwelling
House unto such person or persons (of my own Kindred by
Consanguinity) and to his her or their Heirs and Assigns
forever as my said Wife Joan Tito shall nominate and
give it to upon her last Will and Testament in Writing All
the rest and residue of my Goods Chattels Credits and Personal
Estate consisting in Money Plate Household Goods or in any
other thing or things whatsoever to me belonging I give
devise and bequeath unto my said Wife Joan Tito to and
for her use and behoofe for and during the Term of her
natural Life and solely to be at her disposal to and amongst
such of my own Relations by Consangquinity only as she shall
think fit to give the same And I do also hereby make and
ordain my said Wife Joan Tito my whole and sole Executrix
of this my last Will and Testament and I do also hereby
revoke all other Wills by me made and do ratify and confirm
this and no other to stand and be taken as and for my last
Will and Testament In Witness whereof I have hereunto
set my Hand and Seal the Twenty First day of August in the
year of Our Lord One Thousand Seven Hundred and Forty Two
Note that before the Sealing and delivery hereof it is my



Will that my said Wife Joan Tito is to be paid by my said
Cousin Tito Durell when he shall come to enjoy the Estate at
Sturminster the said Sum of Seven pounds by the year Quarterly
during her natural Life and I do hereby charge the said
Estate therewith  The Mark of Robert Tito  Signed SEaled
Published and declared by me the said Robert Tito as and for
my last Will and Testament in the presence of those whose names
are hereunder written who subscribed their Names as Witnesses
hereunto in my presence and at my request  Jere Colborne  Jane
Colborne  Jane Colborne Junr

This Will was proved at London the Third day of
February in the Year of our Lord One Thousand Seven Hundred
and Forty Six before the Right Worshipfull John Bettesworth
Doctor of Laws Master Keeper or Commissary of the Prerogative
Court of Canterbury lawfully constituted by the Oath of Joan
Tito Widow the Relict of the deceased and sole Executrix named
in the said Will To whom Administration of all and singular
the Goods Chattels and Credits of the said deceased was granted
being first Sworn by Commission duly to Administer
