This is the last Will and Testament
of me Mary Tito of the Town and County of Poole Widow of
Robert Tito late of Poole aforesaid Cooper deceased touching the



Disposition of my Estate and Effect who being infirm of
Body but of sound and disposing Mind and Memory
(praised be God) do make and declare the same as followeth
And First I will that my Debts and Funeral Expences be
paid and discharged Also I give to my Daughter Curtis Tito
all the Goods that I sell of every Sort in the Shop of my
Dwelling House next the Street in Thames Street in Poole
aforesaid and in the Room within the Shop and Warehouse
and also All my Household Goods and Wearing Apparel
Also I give unto my Son in Law John Phippard ten pounds
to buy him Mourning Also all my Lands and Tenements
and Leasehold Estates and all the rest residue and remainder
of my Goods and Chattels Money Plate Linnen Securitys for
Money Book Debts and other my Personal Estate whatsoever
and wheresoever not hereing before given I give devise
and bequeath unto my two Daughters Mary the Widow
of George Crisp late of Portsea in the County of
Southampton Gentleman deceased and Curtis Tito and the three
Sons of my late Daughter Elizabeth Phippard deceased in
manner following to wit the whole being divided into
three equal parts two parts whereof I give to my
said Daughters Mary and Curtis and the other third
part thereof I give to my said three Grandsons and to
the Heirs Executors and Administrators of my said
Daughters and Grandchildren as Tenants in common and
equally to be divided between them in three parts as
aforesaid and if either of my said Grandsons shall dye
before attaining the Age of twenty one years and
without lawful Issue living the part and Share of him
so dying shall go to the Survivors and Survivor of them
And I do appoint my said Daughters and my said Son in
Law John Phippard Guardians and Trustees for my said
Grandsons till they respectively come of Age when their
respective parts and Dividends hereby given shall be paid
them or sooner at the Discretion of my said Trustees and
Lastly I do nominate and appoint my said Daughters
Mary and Curtis joint Executrixes of this my said Will
hereby revoking and making void all former and other
Wills by me at any time heretofore made In Witness whereof
I have hereunto set my Hand and Seal the twenty seventh
Day of July in the year of our Lord one thousand seven hundred
and sixty four  Mary Tito  Signed Sealed Published and
declared by the above named Mary Tito as and for her last
Will and Testament in the presence of us who in her
presence and at her request and in the presences of each
other have subscribed our Names as Witnesses  Thos Bailey
Elizabet Orchard  John Seer Noty Pubk

This Will was proved at London the twenty third Day
of October in the year of our Lord one thousand seven hundred
and seventy one before the Right Worshipful George Hay Doctor of Laws
Master Keeper or Commissary of the Prerogative Court of Canterbury
lawfully constituted by the oath of Mary Crisp Widow and Curtis Tito Spinster



the Executrixes named in the said Will to whom Administration
was granted of all and singular the Goods Chattels and Credits
of the said deceased having been first sworn by Commission duly to
administer
