In the Name of God Amen
I Thomas Smith of the Towne and County of Poole Mercer being 
weake in body but of sound and perfect mind and memory praise be there
-fore given to Almighty God doe make and ordaine this my last Will and 
Testament in manner and forme following that is to say First and
principally I commend my Soule into the hands of Almighty God
hoping through the meritts death and passion of my Lord and Saviour
Jesus Christ to have full and Free pardon and forgiveness of all my
Sins and to inheritt everlasting life and my body I committ to the earth
to be decently buried at the discrecon of my Executors hereinafter named 
and as for and touching the disposition of all such Temporall estate as 
it hath pleased Almighty God to bestow upon me I give and dispose 
thereof as followeth First I will that my debts and Funerall expences 
be paid and discharged Item I give grant and devise unto my three 
daughters Sarah Smith Elizabeth Smith and Mary Smith and to the
heirs of their bodyes lawfully to be begotten all that my messuage or 
tenement scituate lying and being in West Street within the said
Towne and County of Poole part whereof is now in the tenure or occupacon
of Nicholas Marshall Clerke and other part thereof in the tenure or 
occupacon of Robert Blackmore together with the gardens and heredi-
-taments thereunto belonging with the appurtences and if either of my
said daughters shall happen to dye without issue of her body begotten
then I give grant and devise the part or parts of such of my said daughter 
or daughters as shall happen to dye without issue of her or their body
in the said messuage or Tenement gardens & hereditaments unto my son
Richard Smith and the heirs of his body begotten and if he shall happen
to dye without issue of his body begotten then I give and grant and devise the 
same unto my sonn Thomas Smith and the heirs of his body begotten
and if he shall happen to dye without issue of his body begotten then I 
give grant and devise the same unto mine own right heirs forever 
Item I give grant and evise my garden plott scituate lying and 


being in or near Market Street within the said Towne and County of
Poole unto mys aid sons Richard Smith and Thomas Smith their heirs
and assignes for ever Item I give unto my said sons Fifty pounds apeece
and I give more unto my said sons my Leasehold Tenement scituate 
lyeing and being at Litchet Minster in the County of Dorsett withall
the lands and hereditaments thereunto belonging for and during all
the rest and residue of my Estate and terme therein yett to come and
unexpired Item all the rest and residue of my personall estate goods
and chattells whatsoever I give unto my said two sons and three
daughters equally to be divided between them and I doe make my
loving kinsman Mr Abraham Smith and Mr Dennis Smith 
my Brother in Law Mr Richard Toop and my loving friend Mr
Thomas Young of the Towne and Councty of Poole full and sole
Executors of this my last Will and Testament unto whom I give 
Ten Shillings a peece to buy them rings and I doe hereby revoke and 
make void all former Wills by me made In Witness whereof I have 
hereunto sett my hand and seale the Eighteenth day of August in the 
second yeare of the reigne of our Sovereigne Lady Anne Queen of 
England &c Annoq one thousand seaven hundred and three 
Thomas Smith Signed sealed published and declared to be the 
last Will and Testament of the said Thomas Smith in the presence 
of Daniel Hyde John Rowland Will Humfrey

A Codicill to be annexed to and to be taken as part of my last 
Will and Testament Inpris I doe hereby ratifye and confirme my
said last Will and Testament in all things except as is herein after 
menconed that is to say whereas I have therein given all the rest and 
residue of my personall estate goods and chattells whatsoever unto
my two sonns and three daughters equally to be divided between
them my Will and pleasure now is and I doe hereby give unto my son
Thomas Smith thereof ten pounds and my quarter parte of the 
Barque or vessell called the Friendshipp of Poole whereof John
Merrimouth is now Master and I give unto my Sister in Law Ann Lockett
and to my Sister Elziabeth Pennell widow ten shilings a peece to buy
them rings In witness whereof I have to this present Codicill sett
my hand and seale the six and twentyeth day of August in the second
year of the reigne of our Sovereigne Lady Anne Queen of England &c
Annoq one thousand seaven hundred and three Tho Smith Signed
sealed published and declared to be as part of the said last Will and
Testament of the said Thomas Smith the Testator in the presence of 
Will Humfrey Wm Fooke John Mackerell
