In the name of god Amen The eight and twentith 
Daie of Maie in the yeare of our lord god one thousand six hundred and eight I 
Thomas Quicke of Newton St Cyres in the County of Devon gen Doe make and
ordaine this my last will and testament in manner and forme following first I bequeath
my soule unto allmightie god my Creator and Redeemer (by whose merrits death
and passion I hope to be saved) and my bodie to be buried in the Chancell of the 
Church of Newton St Cyres aforesaid And I doe give and bequeath unto the poore
people of the parish of Newton St Cyres fortie shillings of lawfull money of England
to be paid by ten shillings yearelie at everie whitsontide for fower yeares next after my decease 
Item I give and bequeath to the repayring of the said Church of Newton St Cyres ten
shillings Item I give and bequeath unto Elizabeth Babbe the daughter of Willm Babb
my sonne in lawe twentie pounds of lawfull money of England to be paid unto her either 
when shee shall accomplish the full age of one and twentie yeares or at the tyme of her marriag
wchich soever of them shall first happen Item I doe give to everie of my daughters that 
is to saie Eleanor Babb Elizabeth Tuckefeild and Anne Pearse to each of them twentie
shillings Item I give and bequeath to everie one of theire Children except the aforesaid 
Elizabeth Babb tenn shillings a peece Also my mynde and intent is and I will devise 
and bequeath that Symon Pyke my servannt shall have dwell in and enioye during 
his lyfe one of the Roomes of the tenement at Smalkabroke in Newton St Cyres 
aforesaid that which he now dwelleth in and enioyeth freelie wthout paying anie rent 
for the same And farder my will is that if the said Symon shalbe evicted or put 
of or from the same by any person or persons whatsoever that have shall or maie have anie
lawfull tytle or intrest therein That then my meaning intent and will is and I 
doe devise and bequeath that my Executors hereafter named shall paie yearelie 
out of my goods and Chattles unto the said Symon Pyke twentie shillings of 
lawfull money of England during the lyfe of the said Symon at the fower most 
usuall feasts of payments of Rents in the yeare by even porcons The first payment thereof

to begynne at the next of the foresaid feasts of payment which shall first happen and come next after such
eviction and putting out as aforesaid Item I give and bequeath to everie of my servannts which shalbe
dwelling with mee at the tyme of my death twelve pence a peece Item I give and bequeath to everie 
of my godchildren twelve pence a peece And my will further is that my Executors of trust hereundr
named shall doe their best endeavor after my decease out of and with my goods and Chattels of my
foresaid legacies thereof deducted to procure if they possible can the Custodie wardshipp and 
marriage of the bodie and lands of my heire or heires to the use and behoof of my said heire
and heires so he bee ordered ruled and advised by them and the survivor of them in the Chose of his
marriage they advising him without cause of Disparagement therein to the advancement of lyving 
and Credit or ells the wardeship so to be procured of bodie and land shalbe to the onelie use of his 
brothers and sisters and for their better preferement And if it shall happen that the said wardeship
cannot be procured and gotten as aforesaid then my will and meaning is that my goods and 
Chattles which shall remaine my debts and funeralls discharged over and besides my legacies 
aforesaid shalbe imployed converted and bestowed by my Executors or the survivors of survivor of 
them for the redeeming of the lande which were given bequeathed and disposed by my sonne John
Quicke deceased by his last will and testament unto John Quicke his sonne Elizabeth Quicke
and Johan Quicke his daughters upon such purpose and Condicon that if certaine somes of monie
were to them paid by his heire that then the said lands shaould remaine come and be to his next 
heire and the yssues of his bodie as by that his said last will and testament more plainelie and
at large it doth and maie appeare And farder my will intent and meaning is that if Andrew
Quicke my next heire apparant shall fortune to dye without yssue before he shall accomplish
the full age of one and twentie yeares and noe such wardeship as is aforesaid shalbe then gotten and 
obtayned by my Executors that then my Executors of trust or the survivor of them shall doe their
best endeavor to procure the wardeship and marriage of John Quick his brother in such sorte and 
upon such Condicons as vefore is lymitted and expressed for the wardeship of the aforesaid Andrew 
Quick And if it shall happen the said John Quick to die without yssue before he shall accomplish 
the age of one and twentie yeares and noe wardeship of him procured as aforesaid nor the land 
redeemed as before is mentioned then my will is that my said Executors in trust shall endeavor
to procure for Elizabeth Quick and Johane Quicke his sisters if they or either of them shalbe then
within age the wardeship and marriage of them as aforesaid of theire brothers And if it shall
happen the said Elizabeth and Johan to dye without yssue before anie wardeshipp obtayned in
manner and forme as is aforesaid or before they or either of them accomplish the age of one and 
twentie yeares then my will intent and meaning is that the said goods and Chattles shalbe 
devided into fower equall parts and three parts thereof equallie to be devided and delivered to eche
of my foresaid three daughters and the other quarter for my daughter in lawe Alice Quicke 
the widowe of my sonne John Quicke deceased And I doe make and appoint Roger Sherland 
and John Babb gent my Executors of trust of this my last will and testament freelie to 
administer and dispose of my goods and Chattles according to the intent and true meaninge
of this my last will and testament during the minoritie of Andrewe Quick my sonnes
sonne or him or her that shalbe my heire or heires untill he the said Andrewe or one of htem shall
accomplish and be of the age of one and twentie yeares and from and after that tyme to the onelie 
use and behoofe of the foresaid Andrewe or of such myne heire or heires as first shall accomplish 
and be of the age of one and twentie yeares whome I from that tyme make my sole Executor 
of this my last will and testament to whome I give and bequeath all my goods and Chattles 
then remayning unbestowed as before is lymited or ????endale or wryting hereunto annexed 
given or expresed lymited or bequeathed And farder more my intent meaning and will is 
that my Executors of trust aforesaid and everie of them shalbe allowed and satisfied of and
for all such reasonable Expenses Charges and payments as they shalbe at in Executinge of 
this my present last will and testament And in regard of such theire paynes taking in
that behalf I doe give to eache of them fortie shillings a peece And I doe also make
ordayne and appoynt my welbeloved sonnes in lawe William Babb John Tuckfild and 
John Pearse my deare frendes Overseers of this my last will and testament as alsoe

to doe as much as in them lyeth to cause the same to be observed and kept according to my will and
mynde herein contained And farder my will and intent is that if anie doubt doe ryse or growe
by reason of anie article clause sentence or bequeath or by reason of anie other matter wtsoever
concerning this my last will and testament or anie thinge herein conteyned my mynde and 
intent is to have the same discussed ordered deanied and determined without farder suite in lawe
by my said Executors of trust and my survivors and the survivors of them or the most part of 
them And whosoever shall refuse to be ordered censured and denied by them and the 
survivors or survivor of them concerning anie gifte or legacie herein to him her or them or anie 
of them given willed or bequeathed shall leese and forfeite all such giftes legacie and
bequeaths so contended for and refused to be ordered in as aforesaid as if such gifte and
bequeath had never byn made anie herein contayned to the Contrarie notwithstanding
And in regard of such my Overseers paines to be taken in that behalf I doe give
to each of them twentie shillings a peece In witnes whereof I the said Thomas Quick
have hereunto put my hand and seale the daie and yeare first above written witnesses
at the signeing and sealing hereof were present those whose names are subscribed Willm
Burgyn James Quick Robert Rogers Item I give and bequeath to Agnes Errell
my servant and to everie other of my servants men weomen and boyes twentie shillings
a peece over and besides their wages to them due Also my will and meaneing is that 
Symon Peekes wife shall have the romes of the tenement at Smalelebroke in the wch
her husband now dwelleth for and during the tearme of her lyfe in like manner as I 
have given it by this my will to the said Symon Item I give devise and bequeath all
my lands and tenements in Newton saint Cyres and all other my inheritannce 
within the Countie of Devon to my Executors within menconed for and during the
tearme of eight yeares next ensueing the date of my death fullie to be compleate 
and ended and my mynde and intent is that my said Executors shall imploye 
yearelie the revenewes yssues and profitts thereof groweing comeing and encreasing for 
the educacion and bringing upp of three of the younger Children of my sonne John
Quicke late Deceased in learneing and supplying their wants in all necessaries fitting 
there degree and Callinge Item whereas Willm Gribell is indebted to mee by bill in 
the some of twentie shillings and also one Dorathie Quicke widowe in like manner is
indebted and doth owe mee twentie shillings my will and meaning is that they the 
said William Gribell and Dorathye Quicke shall have and reteyne the same to
theire owne use and behoof of my free guifte and thereof for ever to be acquitted and
discharged against mee and my Executors And soe I the said Thomas Comitting 
my soule to the Allmightie doe end this my last will and testament In witnes
whereof I the said Thomas have hereunto sett my signe and sealve yeven the five 
and twentith daie of Aprill 1610 witnesses to the publishing and deliverie hereof
