In the Name of God Amen
I Pinnell Phipard of the Towne and County of Poole marriner being 
in perfect health and of sound and perfect mind and memory (thanks be to
Almight God for it) being bound out in a voyage to sea and being alsoe
willing (knowing the uncertainty of this mortall life) to setle my worldly affairs
and to dispose of that Temporall estate which God in his mercy hath lent
me doe make this my last Will and Testament in manner and forme 
following Inprimis I give and bequeath my soule into the hands of Almighty
God my Creator in hopes of Eternall life through the meritts and mediacon 
of Jesus Christ my only Lord and Saviour my body I committ to the earth or
sea as God of his almighty providence shall please to dispose thereof And my
Will is that all my just debts and funerall expences shall be duely paid and 
discharged by my Executrix hereafter named Item I give and bequeath 
unto my nephew Thomas Phipard and William Phipard sons of my
Brother William Phipard of the said Towne and County marriner
deceased the sume of Fifteen pounds of lawfull English money each to be paid 
unto their Mother Mary Phipard to be laid out quarterly for their Schooledge
and learning untill the whole shall be expended Item I give and bequeath unto
my neece Mary Barfoote daughter of Stephen Barfoote of the said Towne 
and County Blockmaker Twenty pounds of lawfull English money to be
paid unto the said Mary when she shall attaine unto the age of Sixteen yeares 
Item I give and bequeath unto the poore of poole aforesaid Tenn pounds to be
laid out in bread and meat to be given them at or after my decease at the
discretion of my Executrix hereafter named Item I give and bequeath unto
my two daughters Mary Phipard and Hester Phipard     (after the
decease of my wife Hester) my liveing at Holnhurst holden by Lease of my
Father in law Samuell Hookey during the life of the said Mary by whose
life it is holden with this provisoe notwithstanding that the same shall not
be sold during the life of the said Mary (unless a liveing of the like vallue or
some other like valluable Consideracon or assurance shall be settled on the
said Mary and Hester equally) but that the rents issues and profitts of the
said liveing shall be equally devided between them Item I give and bequeath
unto my said two daughters Mary and Hester each of them four hundred
sixty and five pounds lawfull English money over and above their
respective shares in the Eight hundred pound Bond given my said
Father in law Samll Hookey for makeing good four hundred pounds to
my wife and Children at my decease (so as my said wife Hester be not with
child at my departure out of Engand this voyage for Virginia) but if my
said wife shall prove to be with child at my departure out of England as
aforesaid and that she shall be delivered of one or more Child or Children 
so that at my decease or after I may have three Children or upwards liveing then
in such case my Will is that all the moneys herein given to my said two Children
Mary and Hester and alsoe the proffitt and issues of my said liveing at Holnhurst
shall be equally divided between so many Children as I shall have liveing at
or after my decease and moreover my Will is that if at or after my decease I shall
have three Children or more liveing in such case my Will also is that my


wife Hester shall make good and pay unto my said Children one hundred
pounds lawfull English money out of the moneys herein after given her by
this my Will to be equally divided betweene them And my Will is that all
the said moneys given to my said Children in manner before menconed
by this my Will shall be paid unto them as soone as they shall respectively 
attaine unto the age of one and Twenty yeares or day of marriage 
which shall first happen and if any or either of my said Children shall
happen to dye before he she or they shall attaine to the age of one and 
Twenty years or day or marriage in such case my Will is that the legacie
given to such child or Children soe deceasing shall be and remaine to be
equally divided and enjoyed by and between the survivors or survivor 
of them But if it shall please God that all my said Children shall dye 
before any (either of them shall attaine to the age of one and Twenty years
or day of marriage as aforesaid in such case I give and bequeath unto
my honoured father William Phipard the profitts of the moneys soe
given and bequeathed unto my said Children or the nett issues and 
profitts of such estate as shall be purchased therewith for and during
his naturall life he paying out of the same unto my said wife Hester
during her naturall life if my said Father shall survive my said
wife otherwise during the life of him my said Father the sume of 
Twenty pounds of lawfull English money yearly cleare of all
charges whatsoever) dureing the terme aforesaid and after the 
decease of my said Father I give the moneys aforesaid or the estate to
be purchaed therewith as aforesaid unto my nephew William
Phipard youngest son of my said Brother William Phipard 
deceased To have and to hold the same to him and his heires for
ever he or they paying out of the same unto my said wife Hester 
if liveing the sum of three hundred pounds of lawfull English mony
and to my sister Christian Thomes wife of George Thomes her
heirs or assignes Fifty pounds of like lawfull English money and to
my sister Martha Barfoot wife of Stephen Barfoot her heirs or assignes Fifty
pounds of like lawfull English money and to my sister Joane Bond wife of 
Joseph Bond her heirs and assignes fifty pounds of like lawfull english money
and to my sister Hannah Smith wife of Alexander Smith her heirs and assignes
fifty pounds of like lawfull English money and to my nephew Thomas 
Phipard eldest sonne of my said Brother William Phipard deceased his
heirs and assignes Two hundred pounds of like lawfull English money Item
I give and bequeath unto my loveing wife Hester all my household goods
and one hundred sixty and seaven pounds in money over and above
her part or share in the Bond of Eight hundred pounds above menconed 
for makeing good four hundred pounds to her and my Children at my
decease she paying out of the said one hundred sixty and seaven pounds
one hundred pounds as is above limitted in case I shall have three Children
or more liveing at or after my decease and not otherwise but if in case my
estate by means of any Loss at Sea or bad debts or charge in Law for
recovery of any debts shall not amount unto the sume of Twelve 
hundred pounds in such case my Will is that my said wife Hester shall
beare one fifth part of all such Loss and charges or of such sume or sumes of
money as by reason of such Losse and charges my estates shall fall short
of twelve hundred pounds and abate the same out of the moneys given
her by this my Will and my Children to abate four fifths thereof out of 
the moneyes given them by this my Will equally between them And


in case my estate shall arise to more then Twelve hundred pounds in such
case I give the overpluss unto my said wife Hester and my said Children equally
to be divided between them and my Will is that my said Children shall remain
with my said wife and be educated in such manner as my said wife in her
discretion shall see fitt and as the profitts of my said Childrens Legacies will
maintayne (which said profitts I doe will may be laid out by my said wife for
that purpose) untill they shall respectively attaine to the age of fourteen years
if my said wife shall soe long live and remaine a widdow but if my said wife
shall dy or be married before my said Children shall respectively attaine to the 
age of fourteen years in such case my Will is that my Trustees hereafter 
menconed shall take my said Children unto their care untill they respectively 
attaine to the age of fourteen years to be educated as aforesaid and my
Will is that my Executrix and Trustees under menconed doe imediatly 
after my decease and probate had of this my Will sell and dispose of all
my part in Shipping and all my goods of nature soever (my household goods 
excepted) and call in all such moneys as shall be due to me at my decease for ???
mony for payment of my debts and legacies aforesaid and that as soon as 
soone as money shall come to the hands of my Executrix to make up my said 
Childrens Legacies my will is that my said Executrix and my Trustees 
Joyntly doe (as soone as possible may be lay out the whole or any part there
of in an estate of Free hold in their names in Trust for my said Children
and to their uses equally but if such an estate cannot be purchased in
some shorte time after my decease either for want of the whole mony
in hand to purchase the same or for want of a convenient and sutable 
purchase to be had in such case my Will is that untill such estate doth
present my Executrix and Trustees joyntly doe from time to time as mony
shall come to the hands of my Executrix put out the same to use at land
interest uppon good security either reall or personall for three or six
months time and no longer so that the mony may be called in in 
short time when their shall be occasion fitt to lay it out in such estate
And I doe hereby nominate and appoint my loveing wife Hester Phipard 
to be sole Executrix of this my last Will and Testament and I doe alsoe
hereby nominate and appoint my honoured Father William Phipard
and my honoured father in Law Samuell Hookey aforemenconed to be
my Friends in Trust and I doe pray and desire them to take care that this
my last Will and Testament may be duely executed and performed
according to the true intent and meaning thereof and I doe hereby enjoy???
my said Executrix not to pay or receive buy or sell anything in pursuance
of this my Will without the knowledge consent and approbacon of my
said friends in Trust And I doe hereby make void all former Wills and
Testaments by me made and I doe declare this to be my only and last
Will and Testament In witness whereof I have hereunto sett my hand
and seale the nineteenth day of March in the second year of the reigne 
of our Sovereigne Lady Queen Anne over England &c Annoq Dni
1702/3 Pinnell Phipard to be his only and last Will and Testament 
in presence of Tho Hyde Alex Smith Edw Dirham Moses Durell
