In the Name of God Amen
the Sixth day of October Anno Dom one thousand Seaven hundred
and three I Henry Jubber the elder of the Towne and County of Poole 
Merchant being sick and weak of body but of sound and perfect mind 
and memory (praise be given to Almighty God for the same) doe 
make and ordaine this my last Will and Testament in manner and 
forme following (that is to say) First I commend my Soul into the
hands of Almighty God hopeing through the merritts death and 
passion of his sonn Jesus Christ my Saviour to receive full pardon
and remission of my Sinns and my body to the Earth to be decently
buryed in the Parish Church yard of Corfe Mullen in the County 
of Dorsett by my Executor hereafternamed And as for my Worldy
Estate wherewith it hath pleased God to blesse me I dispose of 
the same as followeth Imprimis I give devise and bequeath unto
Robert Earle of Sturminster Marshall in the said County of Dorset
Esqr and George Ind of Blandffor in the said County Gent
All that my Messuage Tenement and Lands lyeing and being within
the Parish of Chuton in the Parish of Milton in the County of 
Southton And all that my Farme and Lands in Eglestone in the
Isle of Purbeck in the County of Dorset (which I ormerly purchased 
of Elias Bond Esqr) their Heires and Assignes for ever In Trust 
neverthelesse to and for the use and behoofe of my eldest Sonn
Edward Jubber and the Heires Males of his body lawfully
begotten and to be begotten And for and in default of such Heires 
Males then to and for the use and behoofe of my Sonn John Jubber
and the Heires Males of his body lawfully begotten and to be 
begotten And for and in default of Issue Male of the severall
Bodyes of the said Edward Jubber and John Jubber then to and 
for the use and behoofe of my sonn Henry Jubber and the Heires 
Males of his body lawfully begotten and to be begotten And for 
and in default of Issue Male of all and every of my said Sonns Then
to and for the use and behoofe of my two Daughters Susannah
Gould and Judith Jubber their Heires and Assignes for ever 
as Tennants in Common Provided alwayes and upon this Condicon
nevertheless that if the said Edward Jubber shall by any wayes 
or meanes whatsoever sell or dispose of the Lands in Chuton 
aforesaid before devised to him Then the Devise hereby made 
to him of the Lands in Egleston aforesaid shall be cease and be 
void Item I give devise and bequeath unto my said Sonn John
Jubber All that my Mansion house and Garden thereunto
belonging with the appurtenances scituate lyeing and being in
Poole aforesaid which Sr William Phippard now rents of me 
To have and to hold to him my said Sonn John his Heires and
Assignes for ever Item I give devise and bequeath unto the said 
Robert Earle and George Ind All that my New erected Tenement 
Cellar and the Garden thereunto belonging and the Ordinary use
of the water there at seasonable times with th'appurtenances 
scituate in Poole aforesaid (which one Wm Cleeves now rents of 
me their Heires and Assignes for ever In Trust neverthelesse
To and for the use and behoofe of my said Daughter Judith her
Heires and Assignes for evermore Item I give devise and 


bequeath unto the said Robert Earle and George Ind All
that my Messuage Tenement and Garden thereunto belongin
with the appurtenances scituate in Poole aforesaid wherein
my said Daughter Susannah Gould now liveth their Heires and
Assigns for ever In Trust neverthelesse to and for the use and 
behoofe of my said Daughter Susannah Gould her Heires and
Assignes for evermore Item my will and meaning is that my
said Sonn Edward Jubber shall from and immediately after 
my Decease pay out of the Lands in Eggleston aforesd one Annuity 
of tenn pounds per Annum of lawflul English money clear of all
Taxes to my Daughters Susannah Gould and Judith Jubber for
the Terme of their naturall lives to be equally divided between
them by four quarterly payments Item I give devise and 
bequeath unto my said sonn Henry Hubber and to his Heires and
Assignes for ever All those my two Dwelling houses Orchards and
Gardens with the appurtenances in Blandford Forum aforesaid 
(whcih I now live in) and which I formerly purchased of Mr
Embris Item I give devise and bequeath unto the said Robert Earle
and George Ind their Heires and Assignes All that my Parcell of 
Land called North Leasne and Reads Land lying and being in 
East Orchard in the said County of Dorset (which I purchased of
Robert Fry) In Trust for my Sonn John Jubber and hte Heires 
Males of his body lawfully to be begotten and for want of such Issue
to the use of my Sonn Edward Jubber and Henry Jubber and their
Heires Males equally between them forever Item I give devise and 
bequeath unto the said Robert Earle and George Ind their Heires 
and Assignes All that parcell of Land called Garways lying and
being in Child Ockford in the said County of Dorset (which I 
purchased of my Brother Simon Lanning) In Trust for my sonn
Henry Jubber and the Heires of his body lawfully to be begotten
And for and in default of such Issue To the use and behoofe of my
Sonn Edward Jubber and John Jubber according as tis limitted 
in the Deed of Purchase of the same Item I give devise and 
bequeath unto my Daughter Susannah Gould her Heires and Assignes 
for ever All that parcell of ground scituate lying and being in Corfe 
Castle in the said County of Dorsett Provided that the Bond for the 
Remainder of her portion (now in the hands of Mr Samuell Hookey
be soon after my Decease delivered up to be cancelled to my
Executor hereafter named Item I give devise and bequeath unto
the said Robert Earle and George Ind tenn pounds to be paid them
within Six monethes after my Decase by my Executor hereafter
named for the use of Richard Gould and Elizabeth Goud my
Grandchildren to be equally divided between them Item I give
devise and bequeath unto my daughter Judith Jubber All those severall
Summes of money due and oweing to me on three Mortgages made
by John Wise and James Wise his Son of Poole in the said County
of Dorset and John Cartridge and Tho Cherrett of Corfe Mullen
aforesaid (from and mmediately after my Decease) and all Interest 
and Proceed thereof and all benefit and advantage that shall accrue 
and come from the same And my will and meaning is that if it shall
happen that the said money soe given as aforesaid or any part
thereof shall be lost my reason of badd security or otherwise (within


the space of three yeares to be accounted from the time of my
Death) and shall not make up or amount to the Summe of five
hundred pounds that then it shall be lawfull for my said Trustees
their Executors Administrators or Assignes out of the Rents Issues 
and Profitts of the Estates at East Orchard and Child Ockford before 
devised to the said John Jubber and Henry Jubber to deduct and 
raise sufficient and enough moneys to make up the said Summe of 
five hundred pounds within the said space of three yeares for my
Daughter Judiths use Item I give and bequeath unto my Sonn Edward
my great Silver Tankard Item I give unto my Sonn Henry my little
Silvert Tankard Item I give unto my Daughter Judith my Silver
Tumbler Item I give unto my Sonn John my Silver Salt Item I give 
to my daughter Gould my Silver Cup with two handles Item I give 
to my daughter Judith and my Daughter Gould all my Finest Linnen
Napkins and Damask to be equally Divided between them Item I give 
unto my Daughter Judeth my best Bedd with the Bamblet Curtaines 
and all things belonging to the said Bedd Item my will is that all my
Householdgoods and Utilsills of Householdstuff be equally divided 
between my three Sonns before named and my said two Daughters 
(except what is before particularly bequeathed to them) And I doe 
hereby acquitt and release my Sonn Edward Jubber of and from all
accounts whatsoever heretofore or now at this time unsatisfyed
from him to me And my further will is that my Executor hereafter 
named shall not challenge or demand anything from the said Edward
Jubber in respect of any account or account as aforesaid And lastly 
of this my Will I make and ordaine my Sonn Henry Jubber Executor 
to whom I give and bequeath all the rest of my Goods Chattells 
rights creditts and Estate whatsoever both reall and personall not
herein before by me bequeathed In Witnesse whereof I the said 
Henry Jubber the elder have hereunto put my hand and seale 
the day and yeare first above written Henry Jubber  Signed sealed
published and declared to be the last will and Testament of the said 
Henry Jubber the elder in the presence of Edmund White Christopher 
Batt Tho Lawrence

Memorand that before the sealing and delivery hereof
I doe hereby and by this codicill revoake the Clause in my Will
wherein the Lands in Chuton and Egleston were devised in Trust 
for my Sonns Edward John and Henry And doe hereby declare 
and the true intent and meaning of my will is that the same Lands 
shall be to the use of my sonn Edward Jubber and the Heires 
Males of his body lawfully to be begotten And for default of such
Issue To the use and behoof of my sonns John Jubber and Henry
Jubber and the Heires Males of their bodyes equally to be divided 
between them And for and in default of Heires Males of the said
John and Henry Then to and for he use and behoofe of my two
Daughters Susannah Gould and Judith Jubber their Heires and
Assignes for ever as Tennants in Comon (the Interlineation of these 
Words following being alsoe made before the sealeing and delivery
vizt between the fifth and sixth Lines the word (unto) between the
thirty eighth and thirty ninth Lines the word (Poole) between the three


and fortieth and four and fortieth Lines these words (for my
Daughter Judiths use between the fifty first and fifty second Lines
the word Henry Witness my hand and seale the day and yeare 
abovesaid Henry Jubber  Signed sealed and delivered with the 
Words Tennants in Comon interlined in the presence of Edmund
White Christopher Batt Tho Lawrence
