In the name of God Amen The Twentieth day of December in the yeare of our Lord God one Thou- sand six hundred sixtie eight and in the Twentieth yeare of the raigne of our Soveraigne Lord Charles the second by the Grade of God of Eng- land Scotland France and Ireland King defender of the faith &c I Haviland Hiley of Marsh in the parish of Bloxworth in the County of Dorsett being in health of body and of good and perfect memorie Thankes be given unto Almighty God for it Doe therefore thinke fitt To make and declare this my last will and Testament in manner and forme following That is to say First and principally I com- mend my soule to God that gave it mee, hopeing and assuredly beleeve- ing That by and Through the only merritts of my Lord & Saviour Jesus Christ after this short life is ended to enioy everlasting life in heaven And for my estate in this world I bequeath and dispose in man- ner and forme following Imprimis I give and bequeath unto Ma- ry my wife the somme of Tenne pounds of lawfull money of Eng- land besides what she hath otherwayes accrewing to her by guift or agreement Item I give and bequeath to my eldest sonne William Hiley the somme of one Thousand pounds of lawfull money of England which said somme is in the hands of Sir John Rogers knight as by a ??? mariage from him on a parcell of Land of his called the higher Farme of of Langton Long Blanford in the County of Dorsett doth and may ap- peare More I give and bequeath to him my sd eldest sonne those severall parcells of land of myne That came and descended to me from and by the the guifte of my Father William Hiley which lands are scituate in Poole Item I give & bequeve to my second sonne Peter Hiley Tenne pounds of lawfull money of Englnad Item I give and bequeve unto my grandchild Peter Hiley the yonger sonne and heire apparent unto my sonne Peter Hiley the elder All that my Farme called or knowne by the name of Marsh Farme scituate in the parish of Bloxworth in the County of Dorsett Together with all & singuler the appurtenances to the said Farme belonging or in any wise appertayning To have and to hold the said farme and premisses with all and every the appurtenances unto him the said Peter Hyley the yonger and to the use and behoofe of him the said Peter Hiley the yonger And to the heires of his body lawfully begotten and to be begotten for- ever Item I give and bequeve unto my grandchild John Hiley second sonne of my said sonne Peter Hiley the elder All that my Mansion house Brewhouse maulthouse Orchard garden and all the appurtenances there unto belonging or in any wise appertayning which said mansion house Brewhouse and maulthouse orchard and garden is scituate & being in the Towne and County of Poole in the County of Dorsett And now are in the Tenure and occupacon of him my said sonne Peter Hiley the elder To have and to hold the said Mansion house Brewhouse Mault- house orchard and garden withall and every the appurtenances unto him the said John Hiley and to the use and behoofe of him the said John Hiley and to the heires of his body lawfully begotten and to be begotten forever Item I give and bequeve unto my Grandchild Charles Hiley third sonne of my said second sonne Peter Hiley the elder All that my house or Inne commonly called or knowne by the name of the Buls head Inne scituate in Poole aforesd with all and every the appurtenances to the said house of Inne belonging or in any wise appertayning which said Inne is in the Tenure and occupacon of John Huser or his assignes To have and to hold the said house & Inne and premisses with all and every the appurtenances unto him the said Charles Hiley And to the use and behoofe of him the said Charles Hiley and to the heires of his body lawfully begotten and to be begotten for- ever Item I give and bequeve unto Mary Hiley eldest daughter of my sd second sonne Peter Hiley the somme of one hundred pounds of lawfull money of England To be paid unto her the said Mary Hiley when and at such tyme as she shall come to and bee of the age of one and twenty yeares of her life or to bee lawfully married which of them shall first happen to bee Item I give and bequeave unto Haviland Cuthbert sonne of Robert Cuthbert of London Goldsmith and to Elnor his wife the somme of one hundred pounds of lawfull money of England To be paid unto him the said Haviland Cuthbert when and at such tyme as he shall come to and be of the age of one and Twenty yeares of his life or to be lawfully married which of them shall first happen to bee Item I give and bequeave unto Rachell Hiley the now wife of my said second sonne Peeter Hiley of Poole The somme of twenty pounds of good English money to be paid her every yeare by my executors hereafter to be named which said payment of twenty pounds yerely is to beginne at the decease and death of her husband the said Peter Hiley And then and from thence forth to be duely paid her That is to say five pounds every quarter of a yeare and soe to continue during the tyme that she remaines a widow and unmarried Item I give and bequeave unto the poore people of Poole Tenne pounds to be distributed a- mongst them by my overseers hereafter to bee named And lastly I doe con- stitute and appointe my three grandchildren before named That is to saye Peter Hiley the yonger John Hiley and Charles Hiley the three sonnes of my second sonne Peeter Hiley to be the executors of this my last will and Testament unto whome I doe give and bequeave all the rest and remayning parte of my estate to bee equally devided and parted betweene them whatsoever and where- soever it bee All lands Leases Bonds bills Books debts housholdstuffe or money or any thing else whatsoever That may appear to be myne (That only excepted which I have herein before said given and bequeaved unto them the said Peter Hiley John Hiley and Charles Hiley and their and every of their heires of their bodyes lawfully begotten and to be begotten forever And further my will and pleasure is That if either of my executors chance to dye without issue of his body lawfully begotten That then his parte soe deceasing of such my estate shalbe equally devided and parted to the survivor or survivors of them and of their heires forever And I doe inttreate and desire my good friends Edmond Butler of Aulmer Esquire Mr Andrewe Ettricke of Sturmister Mr Robert Pitt of Blanford merchant And Mr Thomas Cox of Tomson Clerke To be the overseers of this my last will and Testament unto each of whome I doe give the somme of forty shillings to buy each of them a gold ring desiring them or some of them to take care of these poore children my executors untill they are able to take care for themselves Haviland Hiley Signed Sealed declared and published to bee the last will and
