In the name of God amen I Timothy Bird of the Towne and County of Poole Hosier being in good Health
of Body and of Sound and disposing mind and memory, Thanks be therefore given to almighty God for itt, do make this my last will and
Testament in manner Following that is to say, Whereas I am possessed of the remainder of a Terme of time Hundred ninety
and nine years of and in all that mansion House with the shop Seller Backside Garden and appurtenances thereunto belonging
Scituate in the Towne and County of Poole aforesaid in the Hight Street there and now in my own possession and also of and in one other 
messuage or Tenement with the appurtenances thereunto belonging Scituate in poole aforesaid now in the possession of 
Charles Brickle I give Devise and bequeath the same unto my loveing wife Dorothy Bird for and dureing so many
years of the said Terme as shall run out and expire in her life time and from and after her decease I give Devise and
queath the said mansion House with the Shop Seller Backside and halfe the garden thereunto belonging next to the 
said mansion House unto Thomas Wadham of the Towne and County of Poole aforesaid mariner and William Miller 
of the same place Shipwright their Executors administrators and assignes and the Executors administrators and assignes 
of the Survivor of them In Trust for my son John Bird for and dureing so many years of the said Terme as 
shall run out and expire in his Life time and from and after his decease In Trust to and for Sarah the wife of my
said son John Bird for so many years of the said Terme as shall run out and expire in her Life time if shee shall so
long continue a widow and from and after her death or marriage then In trust to and for my Grandson John Bird
son of my said son John Bird for and dureing so many years of the said Terme as shall run out and expire in his Life
time and from and after his Decease In Trust to and for such child and Children as my said Grandson shall leave att his
death for and dureing the remainder of the said Terme then to come But if my said Grandson John Bird shall happen
to die leaveing to Child att his death then I give the said mansion House Shop Seller Backside and half the said Garden
and appurtenances unto the said Thomas Wadham and William Miller and the Survivor of them and the Executors and 
administrators of such Survivour In trust to and for my son Timothy Bird for and dureing so many years of the 
said Terme as shall run out and expire in his Life time and From and after his decease in Trust to and for such Child
and Children as my said son Timothy Bird shall leave att his death But if my said son Timothy Bird shall
happen to die leaving no Child att his Death then I give the said mansion House Shop Seller Backside and 
halfe the said Garden and appurtenances thereunto belonging unto the said Thomas Wadham and William
Miller and the Survivour of them and the Executors and administrators of such survivour In Trust to and for 
my son Samuell Bird for and dureing so many years of the said Terme as shall run out and expire in his Life 
time and from and after his Decease In Trust to and for such Child and Children as my said son Samuell
Bird shall leave att his death But in case my said son Samuell Bird shall happen to die leaving no Child att his
Death then I give the said mansion House Shop Seller Backside and halfe the said Garden and appurtenances thereunto
belonging unto the said Thomas Wadham and William Miller and the Survivor of them and the Executors and 
administrators of such survivour In Trust to and for my son Thomas Bird for and dureing so many years 
of the said Terme as shall run out and expire in his Life time and from and after his Decease in Trust to
and for such Child and Children as the said Thomas Bird shall leave att his death for and dureing the remainder 
of the said Terme then to come and unexpired and as for and concerning the said other messuage or Tenement now 
in the possession of the said Charles Brickle Together with the Stable or Fewell House and woodlof adjoyning to
the said Tenement with the other halfe of the said Garden next adjoyning to the said Tenement, the use of the
pumps and Cesterne belonging to the said mansion House and also the use of the said Backside and the use of the entry
belonging to the said mansion House I give Devise and bequeath, after the Decease of my said wife, unto my Daughter
Elizabeth Bird her Executors administrators and assignes for so many years of the said Terme as shall run out and expire
in her life time and after her decease to such Chidlren as she shall leave att her Death and if shee shall die leaving no
Child then I give the same to my Daughter Susanna Firth for so so many years as shall run out and expire in her life time 
and after her Death to and amongst the Children of my said Daughter susanna Firth dureing the remainder of the
said Terme then to come and unexpired therein Item I give Devise and bequeath all that my messauge or Tenement
with the room thereunto belonging, under Mrs William's Chamber, with the Hereditaments and appurtenances thereunto
belonging Scigtuate and being in Poole aforesaid in a lane there called Town-gate lane and Lately Descended to me as 
Heir att Law to my Late brother Edward Bird deceased and the Heirs of his Body Lawfully begotten and to be begotten and
for want of such Issue to my said son Samuell Bird and the Heirs of his Body lawfully begotten and to be 
begotten and for want of such Issue to my two Daughters Susanna Firth and Elizabeth Bird and their Heirs for
ever as Tenents in Commmon and not as joynt Tenants Item all the rest and residue of my goods and Chattells whatsoever 
as well reall as personall I give Devise and bequeath unto my said wife Dorothy Bird and do make and
appoint her Sole Executrix of this my present Last will and Testament hereby revokeing and makeing void

All Former wills and Testaments by me att any time heretofore made Declareing 
this to be for and as my only last will and Testament In Witnesse whereof I
have hereunto sett my hand and Seale the Thirteenth    Day of of March
in the Seventh year of the Reign of our Soveraign Lord George the Second King of 
great Britaine and so forth and in the year of our Lord One Thousand Seven Hundred
and Thirty Three

	A Codicill to be Annexed to the last Will and Testament of me Timothy Bird of the
	Towne and County of Poole Hosier

Whereas I have by my said Will given Devised and bequeathed All the rest and residue of my Goods and
Chattells whatsoever as well reall as personall (not expressly given by my said Will) unto my Wife Dorothy Bird
by reason whereof she will be Intitled to the Remainder of a Terme of years which I have yett to come of and in All
that Messuage or Tenement with the Malt House Backside Garden and Appurtenances thereunto belonging scituate and 
being in Poole aforesaid in a Lane or Street there called To?? gate Lane and now in the possession of my son Timothy
Bird And also to the remainder of a Terme of years which I have yett to come and unexpired of and in a Chamber 
and Garrett with the Appurtenances in Towne gate Lane aforesaid now in the possession of Thomas Lilley and over a
Tenement now in the possession of William Preston and of the peice of Garden ground belonging thereto and the use of the 
Backside and pump now used therewith the Lands of which being the Land of Thomas Williams Now I do give Devise and 
bequeath All that the said Messuage or Tenement with the Malt House Backside Garden and Appurtenances thereunto
belonging in Towne gate Late aforesaid and now in the possession of my said son Timothy Bird, after the decease of my said
Wife Doroth Bird, unto him my said son Timothy Bird and his Assignes for and dureing so many years of the said Terme as
shall run out and expire in his Life time and from and after his Decease To Susannah the now Wife of my said son Timothy
Bird for so many years of the said Terme as shall run out and expire in her lifetime, if she shall so long continue a Widow
and in the name of my said son Timothy Bird and from and after the Decease or Marriage of the said Susanna Bird which 
shall first ????? I Give Devise and bequeath the said ????age or Tenement Malt House Backside Garden and premisses
with the Appurtenances in the possession of my said son Timothy Bird unto my son Samuell Bird and his Children share and share 
alike for and dureing the Remainder of the Terme of years which shall be therein then to come and unexpired
And the said Chamber and Garrett now in the possessino of the said Thomas Lilley and peice fo Garden ground
belongeing thereto and use of the said Yard  pump and Appurtenances therewith used and enjoyed I Give Devise 
and bequeath, after the Decease of my said Wife Dorothy Bird, unto my Daughter Susanna Frith and her Children
share and share alike for and dureing the remainder of the Terme of years which shall be therein then to come and 
unexpired In Witnesse whereof I have hereunto sett my hand and Seal the Seventeenth Day of December in
the year of our Lord One Thousand Seven Hundred and Thirty Seven
