21 January 1794 Will of John Bird the younger of Poole, shopkeeper (proved 28 September 1803)

This is the last Will
and Testament of me John Bird the younger of the 
Town and County of the Town of Poole Shopkeeper
which I make in manner following that is to say
all my just Debts Funeral Expences and the charges of
the probate of this my Will to be first paid and
discharged out of my personal Estate I give and
bequeath to my Dear Wife Ann the use and
Enjoyment of such part and so much of my Household
Goods and Furniture Plate Linen and China as she
may think proper for and during the term of her
natural life and I do hereby desire my Executors
hereinafter named to take a parcular Inventory
signed by her of what she shall so elect to take And 
I also give and bequeath to her my said dear Wife
and aher Assigns for and during the term of her
natural life the Interest Dividends and proceed which
shall from time to time arise and grow upon and
from one Moiety or half part of the whole amount
of the Gains or Nett profitts of my Trade and other
my Savings from the twenty eightth day of August
in the year one thousand seven hundred and ninety
two to the day of my death and I request my Executors
hereinafter named as soon as conveniently may be
after my death to make and cast up an amount of
such my Gains or nett Profits and Savings and I do
hereby direct that they shall with all convenient



speed place One Moiety or half part of the amount
thereof out at Interest either on Government or Real
Security and permit and suffer my said Dear Wife and
her assigns to receive such Interest Dividends and
proceed of the same as aforesaid and whereas I am
Entitled in Remainder after the death of Mary Wills
without Issue to divers Lands and Tenements by
virtue of the Will of Aaron Durell late of Poole
aforesaid deceased Now I do hereby give devise and
bequeath to my said Son George all those Lands
Tenements or Hereditaments so devised to me by him
the said Aaron Durell in Remainder as aforesaid To
hold to him my said Son George his Heirs Executors
Administrators and Assigns absolutely for ever or
accourding to my Estate and Interest therein and as
to the said Household Goods and Furniture Plate Linen
and China and the said Moiety or half part of the
amount of my said Gains or nett Profitts in Trade
and other my Savings which shall be so put out as
aforesaid after the death of my said dear Wife and
also as to all the rest residue and remainder of my
Estate and Effects both Real and personal which I
may die seized possessed of or entitled to and not
hereinbefore disposed of I Give devise and bequeath
the same and every part thereof to my said Sons
David and George To hold to htem my said Sons
David and George their Heirs Executors administrators
and Assigns for ever or according to my Estate
and Interest therein equally between them share and share alike
and to take as Tenants in common and not as
joint tenants provided that in case both my said
Sons shall happen to depart this life before their 
attaining the age of twenty one years and without
lawful Issue then it is my Will and I do hereby
give devise and bequeath not only the said
Household Goods and Furniture Plate Linen and
China and the said Moiety or half part of the
amount of my Gains or nett profits in Trade and
other my savings as aforesaid but also the said
Lands and Tenements so devised to me in remainder
as aforesaid and the said residue and remainder of
all my Estate and Effects unto my said Dear Wife To
hold to her my said Dear Wife and her Assigns for and
during the term of her natural life and from and
after her decease I give devise and bequeath the
same and every part thereof to and amongst my
own Relations and kindred in such proportions
manner and form as she my said Dear Wife shall by
any Deed or Will duly executed direct or appoint and
for want thereof to and amongst such of my own
relations and kindred as would have been entitled to
a distributive share of my personal Estate in case I



had died Intestate leaving no widow or Child It being
my express Will and desire that in the event of both
my said Sons dying under the age of twenty one
and without Issues as aforesaid that my said Dear Wife
shall have the benefit and enjoyment of such my
Estate and property for and during her natural life
only and not the power of disposal thereof to any
person or persons after her decease who shall not
be my own kindred and I do hereby nominate
constitute and appoint Thomas Crew of Poole
Merchant and James Cherrett also of Poole aforesaid
Shipbuilder Executors of this my Will and Guardians
of my said Sons during their Minority And lastly
revoking all former Will or Wills by me heretofore
made I do declare this only to be my last Will and
Testament In Witness whereof I the said John Bird
the Testator have to this my last Will and Testament 
contained on Two Sheets of paper set my hand and
seal that is to say to the first subscribed my name
and to the last subscribed my name and affixed my 
seal this twenty first day of January in the year of
our Lord one thousand seven hundred and ninety four

last Will and Testament in the presence of us who
at his request in his presence and in the presence
of each other have hereunto subscribed our names as
Witnesses the said Testator being at the same time of

This Will was proved at London the
twenty Eighth day of September in the year of our
Lord one thousand eight hundred and three before
the Right Honorable Sir William Wynne Knight
Doctor of Laws Master Keeper or Commissary of the
Prerogative Court of Canterbury lawfully constituted
by the Oaths of Thomas Crew and James Cherrett the
Executors named in the said Will to whom
administration was granted of all and singular the
Goods Chattels and Credits of the deceased having
been first sworn duly to Administer
