This is the last Will and Testament of me Ann Bird of the Town and County of Poole Widow made and published this Eighth day of October in the Year of our Lord Christ One thousand eight hundred and four First I give and bequeath unto George Kemp of the Town and County of Poole Merchant and Thomas Crew of the same place Merchant the sum of one thousand pounds part of the Sum of Money I have now on the Mortgage of a house in the said Town and County of Poole and on my Son in Law Mr David Durell Bird's Security not for their or either of their own use But upon this special Trust and Confidence that they the said George Kemp and Thomas Crew and the Survivors and Survivor of them and the Executors and Admors of such Survivor do and shall pay and apply the said Sum of one thousand pounds and the Interest and produce thereof in manner following that is to say the Sum of Five hundred pounds part thereof unto all and every the Children of my Nephew James Clarke the same to be paid and equally dividied between them respectively at their several and respective Ages of Twenty one years or days of Marriage which shall first happen and in case any or either of them shall happen to die before his her or their arrival at the Age of Twenty one years Marriage or Marriages as aforesaid then my Will is that the part or Share of such Child or Children so dying shall go and be paid to the Survivors and Survivor of them at the times aforesaid Share and Share alike and if but one then to such only Child at the time aforesaid and the Sum of Five hundred pounds other part of the said Sum of one thousand pounds unto all and every the Child and Children of my Niece Sarah Cull the same to be paid and divided equally between them respectively at their several and respective ages of Twenty one years or days of Marriage which shall first happen and in Case any or either of them shall happen to die before his her or their Arrival at the Age of Twenty one Years Marriage or Marriage as aforesaid then my Will is that the Share of such Child or Children so dying shall go and be paid to the Survivors and Survivor of them at the times aforesaid Share and Share alike and if but one then to such only Child at the time aforesaid and I direct that the Interest and produce of the said several Sums of Five hundred pounds and Five hundred pounds until the several respective Share and Shares thereof shall become due and payable by virtue of my said Will shall be paid and applied in manner following the Interest of Six hundred pounds part thereof unto my Sister Esther Brown and her Assigns and the Interest of Four hundred pounds the remaining part thereof unto my said Nephew James Clarke his Executors and Admors and my said Niece Sarah Cull her executors and Admors and in case my said Sister Esther Brown shall happen to die before such parts or Shares respectively shall become due and payable then I direct that the Interest of the said Sum of six hundred pounds shall be paid and equally divided between my said nephew James Clarke his Executors and Admors and my said Niece Sarah Cull her Executors and Admors until the time and times aforesaid that the respective Share or Shares of such Children shall become due and payable And it is my express desire and direction that the said principal sum of one thousand pounds shall be continued on the same Security or Securities I have now for the same until the respective Share and Shares thereof bequeathed as aforesaid to the Children of my said Nephew James Clarke and my said Niece SArah Cull shall become due and payable as aforesaid provided the Interest thereof shall be regularly paid to the Satisfaction of my said Trustees but not otherwise I give and bequeath unto my said Son in Law David Durell Bird the Sum of one hundred and Fifty pounds to be paid him at the end of twelve Months next after my decease I give and bequeath unto my said Sister Esther Brown all my household Goods and Furniture of every sort and description I shall be possessed of at the time of my decease in my own right I also give and bequeath unto the Trustees of the Society or Congregation of Protestant Dissenters of the Meeting house on the North side of the Westside Street in Wareham in the County of Dorset whereof the Reverend John Banister is the present Minister their Executors admors and assigns the Sum of Twenty pounds not for their or either of their own use and benefit but upon this special Trust and Confidence that they the said Trustees and the Survivors and Survivor of them and the Executors admors and assigns of such Survivor shall and do place the same out on Governement or other good and sufficient Security and Securities and from time to time pay and apply the clear yearly Interest and produce thereof unto and for the use and benefit of the Minister or parson for the time being of the said Society or Congregation of Protestant Dissenters for his own use and benefit for so long time as the said Society or Congregation shall ???sist as a religious Society of Protestant Dissenters and continue to meet and assemble together for the Worship of God in their present place of relgious Worship in Wareham aforesaid I give and bequeath unto my Niece Sarah Cull a Mourning ring set with pearls given me by the late Mrs Turner I give and bequeath unto Mrs Aldridge the Wife of Mr John Aldridge of Pinwell in the County of Hants my Diamond ring I give and bequeath unto Mrs Wills the widow of Mr Richard Wills my amethyst ring and all the rest residue and remainder of my personal Estate and Effects of every sort and kind soever or wheresoever I give and bequeath unto my said Nephew James Clarke and my said Niece Sarah Cull for their own proper use and benefit equally to be divided between them Share and Share alike chargeable nevertheless with my Funeral Expences and the probate of this my will and I do hereby nominate constitute and appoint the said George Kemp and Thomas Crew joint Executors In Trust of this my Will and my Will is and I do expressly declare that my said Trustees and Executors or either of them their or either of their Executors or admors shall not be charged or chargeable with or accountable for more of the aforesaid Trust Monies than he or they shall actually receive or shall come to his or their respective hands by virtue of this my Will nor with or for any loss which may happen of the said Trust Monies or any part thereof so as the same loss is not occasioned by the Wilful Default nor the one of them for the other of them but each of them for his own act and deed Recepts and defaults only and that it shall and may be lawful for them their Executors and admors out of the said Monies and the produce thereof to deduct and reimburse himself and themselves respectively all such Loss Costs Charges and Expences as he or they shall sustain expend or be put unto for or by reason of the performance and Execution of this my Will or the Trusts hereby in them reposed and Lastly I revoke all former Wills by me made In Witness whereof I have to this my said Will contained in three Sheets of paper to each Sheet set my hand and to this last Sheet my Seal also the said eighth day of October in the year of our Lord Christ One thousand eight hundred and four Ann Bird LS Signed Sealed and delivered published and declared by the said Gregory John Spurrier On the 27th of June 1810 admon with the will annexed of the Goods of Ann Bird late of the Town and County of Poole Widow deceased was granted to James Clarke the Nephew and Sarah Cull Wife of James Cull the Niece and residuary legatees having been first sworn by Comon duly to administer George Kemp and Thomas Crew the Executors having renounced
