This is the last Will and Testament
of me Thomas Pike of Newport Pagnell in the County of Bucks Butcher of
which I constitute and appoint my niece Ann Osborn sole Executrix I direct
my said Executrix to pay all my just debts funeral and testamentary expences
as soon as conveniently may be after my decease out of my personal Estate and
I do give and bequeath all my household furniture plate linen and china
and all the Rest Residue and Remainder of my personal Estate and
Effects whatsoever and wheresoever unto my said Niece Ann Osborn for her sole
use and benefit And I do give and devise all my messuages cottages closes
lands tenements tythes hereditaments and real Estate whatsoever and
wheresoever which I shall be seized of interested in or entitled unto at the
time of my decease unto and to the use of my Friends Thomas Tarry of
Lathbury in the said County of Bucks Yeoman and Thomas Brown of
Newport Pagnel aforesaid Inn holder their heirs and assigns for ever neverthe
less upon and for the trusts intents and purposes hereinafter mentioned expressed and
declared of and concerning the same that is to say upon trust to pay the rents
issues and profits thereof after all necessary and proper deductions thereout
for repairs and Insurance of Buildings into the exclusive and proper hands
of my said niece Ann Osborn for her sole and separate use and benefit for
and during the term of her natural life and so as that the same rents issues
and profits may not be subject or liable to the debts control or engagements
of any husband with whom she may happen to intermarry and for
which rents issues and profits I direct and declare the receipt and receipts of
my said Niece Ann alone whether sole or coverture shall be a sufficient
discharge to my said trustees from time to time And from and after the 
decease of my said niece Ann Osborn upon trust for all and every or such
one or more of the children of my said Niece Ann Osborn lawfully to be
begotten in such parts shares and proportions and subject to such conditions restrictions and limitations ever for the
benefit of all or any one or more of such children as my said Niece Ann
Osborn whether sole or covert by her last Will and Testament in writing or
any Codicil or Codicils thereto or any writing or writings purporting to be her last
Will and Testament to be signed sealed and published in the presence of and to be
attested by three or more credible witnesses and which Will she is hereby authorized
and impowered to make notwithstanding coverture shall direct or appoint And in
default of and as to so much and such part or parts of the premises whereof no
such direction or appointment shall be made and also subject to such direction
or appointment where the same shall happen not to be a complete and entire
disposition and appointment of the whole interest and property therein upon
trust for all and every the child or children of my said Niece Ann Osborn lawfully
to be begotten in equal shares and proportions if more than one as tenants
in common and not as joint tenants and their respective heirs and assigns
for ever But in case my said Niece Ann Osborn shall happen to depart
this life without leaving any child of her body lawfully begotten then I
do will and direct that the trustees or trustees for the time being of this my Will
shall stand seized of the said messuages cottages closes lands tenements tythes
hereditaments and real Estate upon trust for such person or persons for such
estate or Estates interest or interests and to and for such intents and purposes
and subject to such charges powers provisoes declarations conditions and
agreements and in such manner and form as my said Niece Ann Osborn
whether covert or sole shall by any deed or deeds instrument or instruments
in writing with or without of revocations and new appointment to be sealed
and delivered by her in the presence of and attested by two or more credible
Witnesses or by her last Will and Testament in writing or any Codicil or codicils
thereto or any writing or writings purporting to be her last Will and Testament
to be by her signed sealed and published in the presence of and to be attested by
three or more credible Witnesses (and which will she is hereby authorized and
								   empowered


empowered to make notwithstanding coverture) direct limit or appoint the
same or any part thereof And in default of and as to so much and such
part or parts of the premises whereof no such direction limitation or appoint
ment shall be made and also subject to such direction limitation or appoint
ment where the same shall happen not to be a complete and entire
disposition of the whole interest and property int he premises upon trust for
the right heirs of me the said Thomas Pike for ever Provided always and
I do hereby declare that it shall be lawful for the said Thomas Tarry and
Thomas Brown their heirs and assigns or the trustees or trustee for the time
being of this my Will by the direction in writing of my said Niece Ann Osborn
during her life whether covert or sole to sell and dispose of all or any part
of the said messuages cottages closes lands tenements tythes hereditaments
and real Estate so devised as aforesaid either by public Auction or private
Contract and either together or in parcels as to them or him shall seem
expedient for the best price or prices in money that can be reasonably had or
obtained for the same and to convey and assure the same accordingly And I
will and declare that the receipt or receipts of the said Thomas Tarry and
Thomas Brown or the trustees or trustee for the time being of this my Will for
the money for which the hereditabments and premises which shall be so sold
under the provision last aforesaid shall from time to time be a sufficient
discharge or sufficient discharges to the purchaser or purchasers of the same
hereditaments and premises or any part or parts thereof for this her or their
purchase money or so much thereof as shall be therein acknowledged or
expressed to have been received And that such purchaser or purchasers his
her or their heirs executors administrators or assigns or any of them shall not
afterwards be answerable or accountable for any loss misapplication or non-
application of such purchase money so expressed to be received or any part or
parts thereof Provided always and I do hereby will and direct that when
and as any monies shall be received from any sale or sales to be made
under the power hereinbefore for that purpose contained the trustees or
trustee for the time being of this my Will shall with all convenient speed
(with the consent of my said Niece Ann Osborn if living to be testified by
writing under her hand whether covert or sole and after her decease then
of the proper authority and discretion of the said trustees or trustee for the
time being be laid out and invested in the purchase of other Freehold or
copyhold messuages lands or hereditaments to be situate and being some
where in England or Wales And the hereditaments so to be purchased shall
be conveyed surrendered and assured to for and upon such uses trusts intents
and purposes and under and subject to such powers provisoes declarations and
agreements as are in and by this my Will limited expressed declared and
contained of and concerning the several hereditaments hereinbefore given
and devised or as near thereto as the circumstances of the case will then permit
Provided nevertheless and I do hereby also declare that in the mean time and
until the monies to arise by such sale or sales shall be laid out and invested
in a purchase or purchases in the manner hereinbefore mentioned it shall
be lawful for the said trustees or trustee for the time being to place out and
invest such monies in some or one of the public or parliamentary stocks or
funds of Great Britain or at Interest upon Government or real securities in
England or Wales and from time to time to alter vary and transpose wuch
stocks funds orsecurities for or into new or other stocks funds or securities
of the same or the like nature as often as such trustees or trustees shall
think proper And that the interest dividends and annual produce arising
from such stocks funds or securities shall from time to time go and be paid
to such person or persons and be applied to and for such trusts intents and
purposes and in such manner as the rents and profits of the hereditaments
to be purchased therewith woudl go or be payable or applicable to in case such
purchase or purchases were actually made Provided always and my will is


that if the said Thomas Tarry and Thomas Brown their heirs and assigns or
any trustees or trustee to be appointed in the place or stead of them or either of
them as hereinafter is mentioned shall die or be desirous to be discharged from
or refuse or decline to act or become incapable of acting in the trusts of this my
Will before the same shall have been fully executed performed or discharged then
and in such case and so often as the same shall happen it shall be lawful for
my said Niece Ann Osborn whether covert or sole by any writing or writings
under her hand and seal to nominate substitute and appoint any other
person or persons to be a trustee or trustees in the stead or place of him or them
so dying or desiring to be discharged or refusing or declining or becoming incapable
to act as aforesaid adn that when and so often as any such trustee or trustees shall
be nominated as aforesaid all the trust estates and premises shall thereupon with
all convenient speed be conveyed transferred or assured in such manner as that
the same may be legally and effectually vested in the newly appointed trustees or
trustee jointly with the former or continuing trustee of the trust premises or in case
there shall be no continuing former trustee then in such newly appointed trustee or
trustees only upon and for the several trusts intents and purposes hereinbefore expressed
and declared of and concerning the trust premises respectively and that such new
trustee or trustees shall and may in all respects act and assist in the carrying
on and execution of the trusts tow hich he or they shall be so appointed as
fully and effectually and with all such powers and authorities whatsoever as
if such new trustee or trustees had been originally by me appointed And I do
hereby also direct that my said trustees or the trustees or trustee to be appointed
in pursuance of the said lastly mentioned power any or either of them shall not
be answerable or accountable for the acts deeds receipts neglects or defaults of
each other but each of them for his own acts deeds receipts neglects or
defaults respectively notwithstanding their joining in receipts for the sake of
conformity and that they or any of them shall not be answerable for any
loss which may happen int he said trust Esttes and premises unless the same
shall happen by or through their own wilful neglects or defaults respectively And
that my said trustees or either of them shall and may by and out of the monies
which shall come to their hands by virtue of this my Will reimburse themselves
respectively and allow to his or their Cotrustees or Cotrustee all such loss
charges and expences as they respectively shall or may suffer pay sustain or
incur in or about the execution of this my Will or the trusts thereof or in
relation thereto In Witness whereof I the said Thomas Pike the Testator have
to this my last Will and Testament contained in twelve sheets of paper affixed
together at the top with a sale set my hand and seal this thirteenth day of
June in the year of our Lord one thousand eight hundred and thirty one

I the above named Testator Thomas Pike do give and bequeath unto
my brother Joseph Pike my shares in the Newport Pagnel Canal and in
the Buckingham and Newport Turnpike Road And I do desire this bequest
to be taken and considered as a part of my Will above written In Witness
whereof I have thereunto set my hand and seal the same thirtheenth day

Proved at London with a Codicil the 12th September 1831 before the
judge by the Oath of Ann Osborn spinster the Niece the sole Executrix
to whom Admon was granted having been first sworn by Comon duly
