This is the last Will and Testament of me Rebecca Spicer of Somerford Grange in the Parish of Christchurch in the County of Southampton Widow of John Spicer late of the same place Esquire I desire that my body may be buried in the same grave with my late dear Husband in the Parish Church of Christchurch aforesaid I direct all my just debts funeral and testamentary expences to be paid out of my personal estate and if that should prove insufficient then it is my will that my real estate shall be chargeable with the deficiency I give and devise unto my Nephew Robert Paris of the City of London and to his assigns all my Estates at Great Budbridge Little Budbridge Red Mead and Moor in the Isle of Wight in the County of Southampton for and during the term of his natural life And from and immediately after his decease I give and devise the same estates unto his eldest Son Robert Paris his heirs and assigns chargeable nevertheless with the payment of and I do hereby give to Martha the Wife of my said Nephew Robert Paris in case she shall survive him and so long as she shall continue his widow the annual rent or sum of one hundred pounds of lawful British money to be issuing and payable out of the same estates by four equal quarterly payments on the days or times hereinafter mentioned that is to say on the twenty fifth day of March the twenty fourth day of June the twenty ninth of September and twenty first of December in every year without any deduction or abatement out of the same or any part thereof for or by reason of any Parliamentary or other taxes rates or impositions whatever the first quarterly payment of the said yearly rent or annual sum of one hundred pounds to be made on such of the said days as shall happen next after the decease of the said Robert Paris And if the said yearly rent or annual sum of one hundred pounds or any part thereof shall be in arrear or unpaid for the space of twenty one days next after any of the said days or times whereon the same ought to be paid as aforesaid then and at any time or times there after when and as often as the case shall so happen it shall and may be lawful to and for the said Martha Paris into and upon the said lands tenements and hereditaments out of which the said yearly rent or annual sum of one hundred pounds is to be issuing and payable as aforesaid or into or upon any part or parts thereof to enter and distrain for the said yearly rent or annual sum or so much thereof as shall then be so in arrear or unpaid as aforesaid And the distress and distresses then and there found and taken to lead drive carry away and impound and in pound to detain and keep until the said yearly rent or annual sum and all arrears thereof and all costs charges and expences relating to or attending the said distress and distresses shall be fully satisfied and paid and in default thereof in due time after such distress or distresses shall be so taken to appraise sell and dispose of the same distress and distresses or otherwise to demean therein according to Law in like manner as in distresses taken for rent reserved by lease or common demise to the end and intent that thereby she the said Martha Paris may be fully satisfied and paid the said yearly rent or annual sum of one hundred pounds and all arrears thereof and all costs and charges and expences relating to or attending the recovery or obtaining the payment of the same I give and bequeath unto my Nephew William Walter Eloure the sum of five thousand five hundred pounds part of the Three per Cent Consolidated Bank Annui- ties standing in my name in the Books of the Bank of England to and for his own proper use and benefit I give and bequeath unto my Executor herein- after named the sum of four thousand pounds other part of my Three per Cent Consolidated Bank Annuities upon Trust for my Great Niece Martha Ann Paris to be transferred to her at the age of twenty one years the dividends in the meanwhile to be paid and applied for or towards her mainte- nance and education or to accumulate for her benefit I give and bequeath unto my Executor the sum of one thousand pounds other part of my Three per Cent Bank Annuities upon Trust for my Great Niece Rebecca Paris to be transferred to her at the age of twenty one years the dividends in the meanwhile to be paid and applied for or towards her maintenance or education or to accumulate for her benefit I give and bequeath unto my Executor the sum of one thousand pounds other part of my Three per Cent Bank Annuities upon Trust for my Great Niece Emma Paris to be trans- ferred to her at the age of twenty one years the dividends in the mean- while to be paid and applied for her maintenance or education or to accumulate for her benefit I give and bequeath unto my Executor herein- after named the sum of eight thousand pounds other part of my Three per Cent Bank Annuities upon Trust for the Sons of my Nephew Robert Paris to be equally divided between them share and share alike and to be trans- ferred to them as they shall respectively attain the age of twenty one years the dividends in the meanwhile to be applied for or towards their mainte- nance education or bringing up I give and bequeath unto my Executor here- inafter named the sum of one thousand five hundred pounds other part of my Three per Cent Bank Annuities upon Trust to pay the dividends thereof unto Catherine Pouting Wife of Stephen Pouting now or late of Bristol for and during the term of her natural life And from and immediately after her decease to transfer the said sum of one thousand five hundred pounds unto Richard Pouting the Son of the said Catherine Pouting to and for hiw own proper use and benefit I give and devise unto my said Nephew Robert Paris his heirs and assigns All those several estates parcels of land and hereditaments situate near Somerford Grange and Nea respectively in the Parish of Christchurch aforesaid and in the Parish of Milton in the said County of Southampton some of which said estates parcels of land and hereditaments are called or known by the seve- real names of Roeshets, Hambrough, Derham Fields, Welsted, Nundy Coal, Quivers and Ogbear and which said estates parcels of land and hereditaments are now or late were in the several occupations of Hailey Martin Park and Arthur Newman And also all and singular other the messuages lands and hereditaments situate near Somerford and and Nea respectively over which I have any disposing power To hold the same unto my said Nephew Robert Paris his heirs and assigns for ever And as to and concerning all the Rest Residue and Remainder of my monies in the Funds house- hold goods plate linen and china Estates and Effects both real and personal and of what nature or kind soever the same may consist and wheresoever the same may be situate and being I direct the the same and every part thereof to be sold called in and conerted into money and the proceeds thereof after pay- ment of my just debts and funeral and testamentary expences to be paid to or received by my said Nephew Robert Paris his executors administrators and assigns to and for his own proper use and benefit And I give and devise all and every the messuages lands tenements and hereditaments whatsoever whereof I am seized or entitled as trustee or mortgagee with their and every of their appurtenances and all my estate and interest therein unto my said Nephew Robert Paris his heirs executors administrators and assigns upon Trust and to the intent that he my said Nephew Robert Paris his heirs executors or administrators do and shall on payment of such sum and sums of money as shall be due and owing upon or in respect of the several trusts mortgages and securities affecting or charging the said respective premises or which ought to be paid unto my executors or administrators convey assign and assure the said several and respective hereditaments and premises with the appurtenances unto and for the person and persons and his her and their heirs executors administrators and assigns who at the time of making such respective payments shall be entitled to the redemption or equity of redemption of and in the said respective trust or mortgage premises provided always and it is my will and meaning that the said Robert Paris his executors administrators or assigns or the trustee or trustees for the time being of this my Will shall be charged and chargeable only for such monies as he or they shall actually receive by virtue of the trutss hereby in him and them resposed nor shall he or they be answerable or accountable for any Banker Broker or other person with whom or in whose hands any part of the said trust monies shall or may be deposited or lodged for safe custody or otherwise in the execution of any of the trusts hereinbefore contained nor shall he or they be at any time answerable or accountable for the insufficiency or deficiency of any Security or Securities Stocks or Funds in or upon which the said trust monies or any part thereof shall be placed out or invested nor for any other loss which may happen to the aforesaid trust premises (except the same shall happen by or through or their wilful neglect or default) And that one of them shall not be answerable or accountable for the other of them or for the acts deeds defaults receipts or disbursements of the other of them (not- withstanding he or they shall join in any receipt for conformity) but each of them for the acts deeds defaults receipts or disbursements of himself only And also that he the said Robert Paris his heirs executors administrators and assigns or the trustee or trustees for the time being shall and may by and out of the monies which shall or may come to his or their hands by virtue of the trutss aforesaid retain to and reimburse himself and them- selves all costs charges damages and expenses which he or they shall or may suffer sustain expend disburse or be put unto in or about the execution of the trusts hereby in him or them reposed or in relation thereto And I do hereby appoint my Nephew the said Robert Paris Executor of this my Will hereby revoking all former Wills by me at any time heretofore made In witness whereof I the said Rebecca Spicer the testatrix have to this my last Will and Testament contained in five sheets of paper set my hand to each of the said sheets the twentieth day of July in the year of our Lord one thousand eight hundred and forty six R Spicer signed published and declared by the said Rebecca Spicer the testatrix as and for her last Will and Testa- ment upon the day of the date in the presence of us present at the same time and who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses D Howard Portsea Chas Cole Clerk to Messrs Howard & Parnell Solrs Portsea This is a Codicil to the last Will and Testament of me Rebecca Spicer of Somerford Grange in the Parish of Christchurch in the County of Southampton Widow whereas by my Will bearing date the twentieh day of July one thousand eight hundred and forty six I have appointed my Nephew Robert Paris the Elder of the City of London Gentleman sole Executor thereof It is now my wish and desire that he should act as Trustee and Executor of my said Will jointly with Charles William Martin of Belvidere House in the said Parish of Christchurch Esquire and for that purpose I hereby nominate constitute and appoint the said Robert Paris the Elder and the said Charles William Martin joint Executors and Trustees of my said Will And I hereby give devise and bequeath unto the said Robert Paris the Elder and the said Charles William Martin their heirs executors administrators and assigns all my trust estates monies and premises devised and bequeathed by my said Will upon the trusts therein contained with full power and autho- rity for them to act as Trustees and Executors of my said Will and to exe- cute the trusts thereof in as full ample and sufficient manner as if appoined originally by my said Will And I hereby ratify and confirm my said will in all other respects In witness whereof I have hereunto set my hand this fourth day of January one thousand eight hundred and forty seven Rebecca Spicer Signed published and declared by the said Rebecca Spicer the testatrix as and for a Codicil to her said last will and Testament who in her presence at her request and in the sight and presence of each other have hereunto subscribed our names as witnesses Wm Tanner Solicitor Christchurch Sophy Rebecca Spicer Read Spinster Christchurch In the Goods of Rebecca Spicer Widow deceased Appeared Personally William Tanner of the Parish of Christchurch in the County of Southampton Solicitor and made Oath that he is one of the subscribed witnesses to the Codicil to the last Will and Testament of Rebecca Spicer late of Somerford Grange in the Parish of Christchurch aforesaid Widow deceased the said Codicil being hereunto annexed and bearing date the fourth day of January one thousand eight hundred and forty seven And he further made Oath that on the fourth day of January aforesaid the said testatrix duly exe- cuted the said Codicil by signing her name at the foot or end thereof in the presence of this deponent and of Sophy Rebecca Spicer Read the other witness thereto both of whom were present at the same time and this deponent and the said Sophy Rebecca Spicer Read thereupon attested and subscribed the said Codicil in the presence of the said testatrix Wm Tanner On the twenty fourth day of November 1847 the said William Tanner was duly sworn to the truth of this Affidavit by virtue of the annexed Commission Before me W. F. Burrows Commissioner Proved at London with a Codicil 27th Novr 1847 before the Judge by the Oaths of Robert Paris Esqr the Elder the Executor named in the Will and Charles William Martin Esqr the Executor named in the said Codicil to whom Admon was granted having been first sworn by Commission duly to administer
