The last Will and Testament
of me Elias Spencer of the Town and County of Poole Mariner
made and Published this eighth day of April in the Year of our
Lord One thousand Seven hundred and Fifty four first I give
devise and bequeath unto my dear and well beloved Wife
Elizabeth all and singular my Lands Messuages Hereditaments
and Premisses whatsoever and wheresoever in the Kingdom
of England Newfound Land or elsewhere To hold to my said
Wife and her Assigns during her natural Life only without
Impeachment of or for any manner of Waste and from and
immediately after her decease I give and devise the same
to my own right Heirs forever also I give and bequeath
unto my Godson and Cousin John King now an Infant at
Baydeverds in Newfoundland the sum of Fifty Pounds to be
paid him by my Executrix hereafter named at his age of
Twenty one years Provided he shall attain that age and
not otherwise also all the rest and residue of all and
Singular my Goods Chattells and Personal Estate whatsoever
and wheresoever I give and bequeath unto my said Wife
Elizabeth her Executors Administrators and Assigns she paying thereout
all my debts and Funeral Expences and I hereby make and
appoint my said Wife whole and Sole Executrix and Residuary
Legatee of this my last Will and Testament and I hereby revoke
and make void all former and other Will and Wills by me
heretofore made and I hereby ratify and confirm this to be
my only true last Will and Testament In Witness whereof
I the said Elias Spencer have to this my last Will and
Testament Set my hand and Seal the day and year first above
written.  Elias Spencer.  Signed Sealed Published and declared
by the said Testator as and for his last Will and Testament
in the Presence of us who Subscribed our Names as Witnesses
thereto in his Presence and at his request and in the Presence
of each other even the day of the ?ate thereof. John Simmonds

I the within named Elias Spencer the Testator do
make this Present Codicil which I order and direct shall be taken
as and for Part of my within written last Will and Testament and
which Will as to all and every the devises Bequests and Legacys
therein mentioned devised given and contained of and concerning
my Real and Personal Estates therein mentioned I do by this
my Codicil Establish ratify and confirm save and except such
devise or Bequest therein mentioned as is by me hereinafter
revoked and made void Whereas I have my by said Will
given and bequeathed unto my Godson and Cousin John
King therein named the sum of Fifty Pounds to be paid him
in manner therein mentioned Now I do hereby revoke and
make void the said Bequest or Legacy of Fifty Pounds so by
me within mentioned to be give and bequeathed unto the
said John King to all Intents and Purposes as if the same had



never been bequeathed and which said Sum of Fifty Pounds I will
shall be deemed and taken as Part and Parcel of the Residuum
of my Personal Estate by me within mentioned to be given and
bequeathed unto my said dear Wife within named and my
Will and meaning is that this Codicil shall be adjudged and
taken as Part and Parcel of my said last Will and Testament and
a full Declaration of the same In Witness whereof I have to
this my Codicil Set my hand and Seal the Seventeenth day of June
in the Year of our Lord One Thousand Seven hundred and Fifty
seven.  Elias Spencer.  Signed Sealed Published and declared
by the above named Elias Spencer the Testator as and for a
Codicil to be added to and be Part of his last Will and Testament
in the Presence of us who Subscribed our Names as Witnesses
hereunto in the Presence and at the requeat of the said
Testator and in the Presence of each other.  Mary Hayter

This Will was Proved at London with a Codicil the Sixteenth
day of December in the year of our Lord one thousand seven
hundred and Fifty seven before the Right Honourable Sir George
Lee Knight Docotor of Laws Master Keeper or Commissary of
the Prerogative Court of Canterbury lawfully constituted by the
Oath of Elizabeth Spencer Widow the Relict of the deased and
Sole Executrix named in the said Will to whom Administration
was granted of all and Singular the Goods Chattells and Credits
of the deceased having been first Sworn by Commission duly to
administer
