This is the last Will and Testament of me Edward Carter of Portsmouth in the County of Southampton Esquire I be- questh to my eldest son Edward Carter and to my second son John Markham Carter and to George Markham Giffard Esquire Barrister at Law and to the executors of the survivor five thousand pounds three per centum Consolidated annuities and five thou- sand pounds three per centum Reduced annuities in trust to pay the dividends during her life to my eldest daughter Louisa the wife of Captain George Evelegh of the Royal Artillery for her sole use and benefit and separate use and benefit and not to be liable to the debts of her present or any future husband and her sole receipt to be a discharge to the trusteees and at her decease the principal stock to be divided equally amongst all her children who may live to attain the age of twenty one years I give the like amount of three per centum consolidated annuities and three per centum Reduced annuities to the same trustees in trust for my second daughter Elizabeth Ann Carter and all her children in the same manner I give to my second son John Markham Carter and his heirs executors administrators and assigns all that farm called Marsh Farm or Farr Farm in the occupation of Thomas Jones situate in the Parish of Ambrosden in the County of Oxford which I purchased of John Greaves and also three policies of Assurance for seven hundred pounds each in the Law Life Assurance Office which I also purchased of John Greaves also all that Farm called Hane Farm or Blackthorne Farm in the occupation of John Jones situate in the parish of Ambrosden in the County of Oxford and the Great Tithes within the said Parish and also three Policies of Assurance for one thousand pounds each in the ??conomic Life Assurance Office all of which I purchased of Messrs Bulpett Dunn and Mulcock also all those four closes of land in the occupation of W Everett situate in the Parish of Carisbrooke in the Isle of Wight which were conveyed to me in the year one thousand eight hundred and thirty eight by Robert Bird Wilkins and others and also all those lands and titles in the occupation of John Morgan called Cockeltons Poll close Steakers and Burnthouse also situate in the Parish of Carisbrooke in the Isle of Wight which were conveyed to me in the year one thousand eight hundred and thirty nine by Mr John Tucker I give to my fourth son Bonham William Carter and his heirs all that estate in the parishes of Hardham Cold Waltham and Greatham in the County of Sussex which came to me by the will of the late Thomas Bonham of Petersfield all the Rest Residue Remainder of my estate both real and personal I give equally between my two sons Edward Carter and Henry Carter their heirs executors administrators and assigns as tenants in common and not as joint tenants and I appoint my two elder sons Edward Carter and John Markham Carter Executors of my will and I direct that the legacy duties of all the aforesaid legacies be paid out of the residue of my personal estate my will is that any disposition of property herein contained is not to extend to any power of appointment I may have over six thousand pounds three per centum Consolidated annuities under my marriage settlement In witness where- of I the said Edward Carter the testator have at the end of this my will signed my name this eleventh day of April one thousand eight hundred and forty nine Edward Carter Signed and declared by the above named Edward Carter the testator as and for his last will and testament in the presence of us present at the same time who in his presence and the presence of each other have hereunto set our names as witnesses hereto Edwd Hunt Thos Bigwood This is a Codicil to the will of me Edward Carter of Portsmouth in the County of South- ampton Esquire dated the eleventh day of April one thousand eight hundred and forty nine which I confirm with the following exception whereas I have given to the trustees of my son John Markham Carter by his marriage settlement the sum of five thousand pounds three per centum Reduced annuities Now I do hereby give to my son Henry his heirs executors administrators & assigns all those four closes of land in the occupation of W everett situate in the Parish of Carisbrooke in the Isle of Wight which were conveyed to me in the year one thousand eight hundred and thirty eight by Robert Bird Wilkins and others and also all those lands and tithes in the occupation of John Morgan called Cockeltons Poll Close Steakers and Burnt House also situate in the Parish of Carisbrooke in the Isle of Wight which were conveyed to me in the year one thousand eight hundred & thirty nine by Mr John Packer in lieu of my son John Markham Carter to whom I had given them by my will In witness whereof I the said Edward Carter the testator have at the end of this Codicil to my will signed my name this eighth day of August one thou- sand eight hundred and fifty Edward Carter and thank God I have been able to execute this Codicil Signed and declared by the above named Edward Carter the testator as and for his Codicil to his last will and testament in the presence of us present at the same time who in his presence and in the presence of each other have hereunto set our names as wit nesses hereto the word eleventh having been blotted through before execution Tho Bigwood John Astridge This is a second Codicil to the Will of me Edward Carter of Portsmouth in the County of Southampton Esquire I hereby revoke the devise in my first Codicil of the lands and tithes therein described to be in the occupation of John Morgan and conveyed to me by Mr John Tucker and I devise the same to my son John Markham Carter and his heirs and I hereby declare that if I have not sufficient monies in the stock to satisfy the two sums of ten thousand pounds stock given by my will for the benefit of my two daughters and their children the deficiency shall be made up out of my residuary estate and if my said daughters or either of them should not leave children who shall live to be entitled to vested interested in the said trust funds respectively such daughter shall whether married or sole have the power to appoint the trust fund provided for her by will and in default of such appointment the same shall be in trust for such persons as shall be her next of kin at her death as if she had died sole and unmarried and as to both the said funds of five thousand pounds stock I direct and declare that the trustees or trustee thereof for the time being shall have all such powers of investement thereof and of the application of the income and principal thereof for the maintenance and benefit of children as in the settlement of my daughter Louisa is expressed respecting the moneys of how there- by settled for the benefit of her children as if such powers and provisions were herein repeated as applicable to a will and if my trustees or either of them shall die or decline to act the sur- vivors and survivor and the others and other of them shall have the usual power to ap- point other trustees and trustee in their stead And I hereby ratify and confirm my will and first Codicil in all other respects In witness whereof I have hereunto set my hand this tenth day of August 1850 Edward Carter Signed and declared by the testator as and for a second Codicil to his will in the presence of us present at the same time who in his pres- ence and in the presence of each other have subscribed our names as witnesses Edwd Rannie Portsmouth Edwd Hopkins Solr Alresford Proved at London with 2 Codicils 30th Sepr 1850 before the Worshipful Alfred Maddilove Doctor of Laws and Surrogate by the oath of Edward Carter and John Markham Carter Esquires the Sons the Exors to whom admon was granted having been first sworn duly to administer
